Project Description:

IBM Corporation proposes to construct a new chip fabrication facility within Building 323 at the Hudson Valley Research Park. The project requires the following permits and permit modifications:

     State Pollutant Discharge Elimination System (SPDES) permit modification to increase the maximum discharge of treated effluent to Gildersleeve Brook (Classification: "D") from 3.9 million gallons per day to 6.0 million gallons per day at the existing wastewater treatment facility. A draft SPDES permit has been prepared and is available for review. The applicant for the requested permit modification is Empire State Development Corporation, the owner of the facility.

     Freshwater Wetlands in conjunction with the installation of a water pipeline from the Wiccopee well field to Building 323. The proposed pipeline routing crosses Freshwater Wetlands HJ-37 (Class II) and HJ-66 (Class II) for a total distance of 365 linear feet. Approximately 1745 linear feet of pipeline is also proposed within the 100 foot adjacent areas of these wetlands.

     Protection of Water for the installation of a water pipeline beneath the bed of Wiccopee Creek located north of NYS Route 52.

The applicant previously submitted a Title V Air Resources permit application for the Hudson Valley Research Center, including the Building 323 chip fabrication facility. This application is currently under review and will be the subject of future public notices. A stormwater management plan has also been prepared and is available for review.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant proposed to replace the northbound and southbound Taconic State Parkway bridges over Wappingers Creek [DEC Water Index No. H-101; Class B(t)]. The project site is located in the Town of Clinton on the Taconic State Parkway about 800 feet north of the intersection with Hibernia Road. The project involves the stabilization of up to 230 linear feet (70 meters) of the stream banks by placement of stone fill around the bridge abutments and piers. The bridge replacements are part of a larger project that includes rehabilitation of about 1.1 miles of the Taconic State Parkway between Salt Point Turnpike and Hibernia Road.

Applicant proposes to build a new timber bulkhead, approximately 230 feet in length and 8 feet high, at the line of mean high water on the west shore of the Hudson River, in order to protect an existing boat house and the property shoreline from erosion. In addition, a 10 foot by 8 foot timber crib, 6 feet in height, would be built at the mean low water line to provide access to the River, with a 6-foot wide free-standing ramp connecting bulkhead to crib. The bulkhead would be backfilled with approximately 350 cubic yards of clean stone and other fill taken from other areas on the applicant's property.
