The Department has made a tentative determination to approve an application for Excello Film Pak Inc. located at 166 25 St., Brooklyn. The facility has two flexographic printing presses: one four color and one six color. The facility applied for a permit to install a catalytic incinerator in order to comply with 6NYCRR Part 234. The facility must install the catalytic incinerator in accordance with Schedule A of Consent Order R2-0174-97-09. The facility is capping out of 6NYCRR Part 201-6. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

The Department has made a tentative determination to approve an application to modify the Air State Facility Permit for Fresh Kills Landfill, Richmond Ave., Staten Island. To satisfy the emission offset requirements of Part 231, the facility has obtained CO Emission Reduction Credits (ERCs) from the following sources: Greenpoint Municipal Incinerator 2-6101-00022, 259.82 tpy; Betts Avenue Municipal Incinerator 2-6304-00093, 495.02 tpy; and Southwest Brooklyn Incinerator 2-6106-00002, 18.16 tpy . The facility has obtained NOx ERCs from the following sources: Greenpoint Municipal Incinerator 2-6101-00022, 300.2 tpy; Betts Avenue Incinerator 2-6304-00093, 81.8 tpy.` The permit includes the changes to emission unit #4 (the gas treatment plants) and the changes for the emission reduction credits. Project Description:

The Department has prepared a Draft Permit and has made a tentative determination to approve this application. The existing facility at Richmond Avenue, Richmond County, Staten Island, includes a Municipal Solid Waste Landfill which is operated by the New York City Department of Sanitation (NYCDOS) and occupies approximately 2,200 acres of which 771 acres were active, but is no longer accepting waste as of March 22, 2001. The Fresh Kills Landfill consists of (1) The Veterans Avenue Leachate Treatment Plant with a design capacity of 150,000 gpd; (2) the Fresh Kills Leachate Treatment Plant with a design capacity of 900,000 gpd; (3) six landfill gas flares with a design capacity of 5,000 scfm per flare and fugutive landfill gas emissions from the landfill. The flares are operated by GSF Energy, LLC/Fresh Gas, LLC, co-applicant for this emission unit (EU: U00003) and (4) the existing landfill gas recovery plant owned and operated by GSF Energy, LLC, co-applicant for this emission unit (EU: U00004). The recovery plant is being upgraded to increase processing capacity from 10 to 14.1 million standar cubic feet per day of raw land fill gas. The two landfill leachate treatment plants are adjacent to each other and are operated by Roy F. Weston, Inc. The facility is subject to 6NYCRR 231-2, New Source Review in Nonattainment Areas and Ozone Transport Region and 40CFR 520-A.21, Prevention of Significant Deterioration. The facility also has to comply with the Consent Order of May 8, 1990 between NYSDEC and GSF Energy and Consent Order R2-0208-97-10 for construction of an active landfill gas collection system for Emission Unit U-00004 and Process A41. Application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments. Certification reports submitted by the facility are also available for review. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliancee with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
