Voluntary Cleanup Agreement for Remediation

Project Description:

The Volunteer has submitted a Remediation Work Plan to the Department pursuant to an Agreement which was signed by the DEC on April 5, 2000. The Volunteer has agreed to remediate a site located at 166 Central Avenue, Illion, NY. The intended use of the site, following cleanup will be the construction of an approximately 15,000 square foot supermarket. The proposed construction will occur on what is presently five separate, but adjoining parcels, identified as 166-178 Central Avenue. All existing buildings on site are planned to be demolished and the site will include a large paved parking lot.

The site soils contain petroleum related contamination resulting from historical operation of a gasoline station and bulk storage of fuel oils and kerosene. The Work Plan proposes to utilize a Soil Vapor Extraction system with Ozone Sparging Enhancement to remediate contaminated soils in place.

Comment Period:

The Work Plan and Agreement are available for public review at the locations listed below. Written comments on the Work Plan will be accepted for thirty (30) days following the date of this notice. Written comments expressing objection or opposition to the Work Plan must explain the basis of that opposition and identify the specific grounds which could lead the Department to impose significant changes. No formal response is made to the comments received, but, as a result of the comments the Department may re-evaluate and make revisions to the Work Plan.

Negative Declaration

Jefferson County - The Village of Dexter Board of Trustees, as lead agency, has determined that the proposed Amendment to the Village of Dexter Zoning Law will not have a significant adverse environmental impact. The proposed action consists of various amendments to the Village of Dexter Zoning Law. The proposed amendments can be characterized and described as follows: updates so that the Zoning Law conforms with changes made in State Statutes pertaining to planning and zoning; updates to various standards to more accurately reflect existing and desired land use patterns and conditions throughout the Village; to make the Zoning Law easier to understand and administer; to clarify previously existing ambiguities; and to generally avert previously experienced administrative problems in application of certain zoning standards. The project is located in the Village of Dexter.

Jefferson County - The Board of Trustees of the Village of Sackets Harbor, as lead agency, has determined that the proposed Madison Barracks Sanitary Sewer Replacement Project will not have a significant adverse environmental impact. The action involves installation and financing of 6,665 lineal feet of 8" PVC gravity sewer main, four 2,000 gallon grease traps, 6,750 lineal feet of 4" PVC gravity sewer laterals, 32 four-foot diameter precast concrete manholes, one duplex above ground pump station. The project is located at the Madison Barracks Complex, Village of Sackets Harbor.

Jefferson County - The Board of Trustees of the Village of Sackets Harbor, as lead agency, has determined that the proposed Madison Barracks Sanitary Sewer Replacement Project will not have a significant adverse environmental impact. The action involves installation of 9,320 lineal feet of 8-inch ductile iron pipe, 6,420 lineal feet of 3/4" and 1" copper laterals, back flow prevention device, 19 fire hydrants and 19 gate isolation valves. The project is located at the Madison Barracks Complex, Village of Sackets Harbor.

St. Lawrence County - The Town of Louisville, as lead agency, has determined that the proposed East Louisville Water District will not have a significant adverse environmental impact. The action involves the construction of Water Distribution System and Water Storage Tank to alleviate a boil water notice on the Tucker Terrace Private Water System, and solve well quality and quantity problems for residents in the vicinity of the private water district. The project is located on Maple Street (NYS Rt. 37B), NYS Rt. 37, NYS Rt. 31, Browning Cross Road, Kingsley Road, Martin Road, Cline Drive, Butler Avenue, Old Farm Circle, Town of Louisville.

Positive Declaration

Herkimer and Lewis Counties - The New York State Department of Environmental Conservation, as lead agency has determined that management actions proposed in the Independence River Wild Forest/ Westward Waters State Forest/Three Lakes Easement Unit Management Plan may have a significant adverse environmental impact and a draft Environmental Impact Statement must be prepared. The proposed actions may include, construction of recreational trails which may require crossing wetlands, opening for public use motor vehicle roads currently used for administrative purposes and construction of additional parking facilities within the unit. Possible adverse impacts from implementation of the Unit Management Plan may include temporary minor erosion; temporary increased siltation and stream bottom disturbance, increased recreational usage in certain areas and minor noise impacts during the construction of new facilities within the unit. The project is located in Lewis County, Towns of Watson, Greig and Lyonsdale and Herkimer County, Town of Webb.
