Project Description:

The applicant proposes to develop and operate a 6 acre clay mine on his property on the south side of Galloway Road, 1400 feet west of the Kelsey Road intersection, in the Town of Batavia. The mine will operate as a traditional surface excavation of the Cazenovia and Ovid silty clay loams. Excavation will be by mechanical equipment, standard for this type of mining operation. The materials will be mined from above and below the water table; no processing is proposed for the site. Final reclamation will expand an existing seven acre pond to a total water surface of approximately 12 acres.

Project Description:

The applicant has enrolled in the Wetlands Reserve Program, through which the Monroe County Natural Resources Conservation Service has developed a proposal to restore and enhance an existing wet meadow/emergent wetland within NYS DEC regulated Freshwater Wetland HM-4 (Class II), in order to increase its value and attractiveness to waterfowl. Proposed low berm and potholes connected by level ditching have been designed to diversify the habitat to provide more open water/emergent wetland in proximity to existing deciduous forested wetland. These areas of open water interspersed with wetland emergent vegetation will benefit waterfowl, fur bearers, grassland avian species, amphibians, and other wildlife. Project Description:

To accommodate the placement of new docks at their marina facility, the applicant has proposed to raise an old wooden derrick barge of approximately 35' w x 100' l x 10' h, and float it to an area of deep water where it will be sunk. The barge is constructed of large timbers, with extensive timber bracing, and had been residing within the marina facility bottom for several years. The area of disposal selected by the applicant is west of a charted dumping ground, approximately 1.75 miles NNE of Sodus Bay ,in waters having a mean low water depth of approximately 70 feet. The raising and disposal process will take place after the NYS DEC warm water fishery work restriction period ending July 1, when the water elevations are sufficient to prevent adverse impacts to the aquatic habitat, and will be monitored by NYS DEC personnel. The applicant proposes to control roadside vegetation by the use of herbicides along State Route (SR) 21 in Yates County, SRs 332, 96 & 245 in Ontario Co., SRs 14, 31, 104, 89 in Wayne Co., and SR 256 in Livingston Co. Parts of these roadside areas are within the adjacent areas of several NYS DEC regulated Freshwater Wetlands. This vegetation management is aimed at maintaining and improving sight distance and drainage, improving the appearance of right-of-ways, and providing and maintaining a safe work environment for work crews. The application of herbicides will be conducted by NYS DEC-certified NYS DOT employees who will follow the NYS DOT Wayne/Ontario Residency's Herbicide Application Guidelines.
