Project Description:

The applicant proposes to construct a portion of a single family house and lawn within the 100-foot adjacent area of Freshwater Wetland HJ-37 (Class II). The project site is located on the south side of McKeown Terrace, about 1/3 mile north of NYS Route 52. Construction of the house and lawn will result in the encroachment of about 600 square feet and 1550 square feet, respectively, within the wetland adjacent area. A small portion (< 80 square feet) of the septic system expansion area will also be located within the wetland adjacent area.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Project Description:

The Department has made a tentative determination to approve this application to modify a SPDES permit to raise the effluent limit for iron from an existing subsurface discharge of treated stormwater (Outfall #002) collected from paved and roofed areas at the applicant's manufacturing plant. The modification will increase the effluent limit for iron from 1.9 milligrams per liter (mg/l) to 4.0 mg/l and will require the applicant to develop a Best Management Practices (BMP) plan for controlling discharges of toxic and hazardous pollutants to the waters of NY State. The applicant manufactures rubber, plastic and silicone products at the plant located on Charles Colman Boulevard in the Village of Pawling, Dutchess County. A draft permit is available for inspection and comment at the regional office.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

Project Description:

     The Department has received an application from New England Laminates Corporation (NELCO) requesting a permit modification for the purpose of establishing certified emission reduction credits (ERC's) for reductions resulting from the shutdown of the pilot treater which is located at Walden, Orange County, New York. The emission source creased operations on April 8, 1997. The pilot treater previously discharged volatile organic compounds (VOC). The ERC's are generated by permanently removing this emission source from service. The total amount of ERC's generated is 45 tons of VOC's.
