The Department has received a complete application and has developed a draft permit that consolidates existing emission point permits. It establishes facility wide emission caps of 49 tons per year of Volatile Organic Compounds (VOCs) , 24 tons per year of total Hazardous Air Pollutants (HAPs) and 9 tons per year of any individual HAP. These caps are below the major source level so the facility is not subject to Title V requirements. An additional emission unit cap of 20 tons per year of VOCs is established in support of a 2 year extension of an existing waiver which allows the facility to use coatings that do not comply with VOC content requirements of 6NYCRR Part 228. The company has provided documentation that compliant coatings which meet their specific requirements are not available and that the cost of installing a control device significantly exceeds the cost threshold for Reasonably Available Control Technology (RACT). The draft permit also establishes new record keeping and reporting requirements. The project involves stabilization of two sections of streambank along the Boquet River using only vegetative erosion control techniques.

The Department has received a complete application and has developed a draft Title IV (Phase II Acid Rain) permit for the South Glens Falls Energy, LLC facility. This permit will require the facility to hold allowances to cover sulfur dioxide emissions and adds additional monitoring and reporting requirements. The Title IV permit does not change emission requirements which are already addressed in the facility's Title V permit. When the Title IV permit is issued, its requirements will be incorporated into the existing Title V permit. In accordance with 6NYCRR Parts 621 and 201, the administrator of the USEPA has the authority to bar issuance of any Title IV facility permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The applicant proposes to construct a foot bridge to cross the Beaver Brook and Fresh Water Wetland SA-15 (Class I).
