Project Description: The applicant proposes to renovate an existing building into a single family residence, construct a residential driveway, and install the required utilities (water and electric) within the 100-foot adjacent area of Freshwater Wetland KE-27 (Class II). The project site straddles the Village of Rhinebeck/Town of Rhinebeck line and is located on the west side of Montgomery Street, about 0.5 mile north of the intersection with U.S. Route 9. The proposed driveway is 10 feet wide by about 300 feet long. The renovation of the existing building will include construction of an addition 20 feet long by 15 feet wide within the 100-foot wetland adjacent area, and the installation of a septic system entirely outside the 100-foot wetland adjacent area. In addition, several roadside trees and branches will be removed from the wetland north of the proposed driveway entrance to provide the required sight distance. |

Activities proposed within the Freshwater Wetland are the installation of two water supply wells with piping. Activities proposed within the 100 foot adjacent area consist of construction of a new building with gravel and paved parking areas. The project includes revegetation of previously disturbed areas within the Freshwater Wetland. The total area of disturbance to the Freshwater Wetland is less than 0.01-acre; the total area of disturbance to the adjacent area of the wetland is approximately 0.32-acres. The project is located on the north side of NYS Route 52 approximately 2000 feet west of St. Andrews Road in the Town of Montgomery, Orange County. |

Project Description: The New York State Department of Environmental Conservation (DEC) has prepared a Revised Fact Sheet and a Draft Permit Modification, and has made a tentative determination to approve an application for the transfer and modification of the existing SPDES permit for the Lovett Electric Generating Station, in the Town of Stony Point, in Rockland County. The permit would be transferred from the previous owner, Orange & Rockland Utilities, to the current owner Mirant Lovett, LLC (formerly known as Southern Energy Lovett, LLC). The modification consists of permit conditions for continued biological monitoring and mitigation for the impingement and entrainment of aquatic organisms at the plant's cooling water intake structure in the Hudson River.
