This Department has received a request to modify an existing permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit, at the facility located at NYS Route 12E, Cape Vincent, New York which is a New York State run Correctional Facility for emission units 0-0MAIN. This permit includes federally enforceable conditions to limit considered to "cap" emissions below the applicable threshold level set forth in 6NYCRR Part 201. The draft permit with conditions is available for review in the Region 6 NYS DEC office in Watertown, New York.

DEC has made a tentative determination to re-issue this permit for a five-year period, maintaining the current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of 4,000 gallons per day of treated sanitary waste to the Filmore Creek.

The applicant proposes to mine 5 acres of gravel from a 5 acre life of mine, over a 5 year permit term, on a 50 acre parcel owned by the applicant. The site is located approximately 2.5 miles northeast of Brasher Iron Works on the south side of Smith Road 1000' east of Mahoney Road.

DEC has made a tentative determination to re-issue this permit for a five-year period, maintaining the current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of 3,600 gallons per day of treated sanitary waste to the Sub-tributary SL-25-72.
