The applicant proposes to undertake the NFTA Boat Harbor Beach Project, including the following activities: removal of debris; placement of heavy stone fill for erosion protection; beach resurfacing (approximately 1600 feet); personal watercraft launch; boardwalk; fishing pier; floating dock; and two parking lots. The project is located west of Fuhrman Drive and south of the Small Boat Harbor on Lake Erie.

The applicant proposes to operate a construction and demolition debris and recyclables processing facility with a capacity of 500 tons per day. The project site is located at 266 Hopkins Street (at Tifft Street) in the City of Buffalo. This application supercedes the Notice of Complete Application dated November 24, 1999 for a proposed solid waste transfer station at the same location. The previous application for a solid waste transfer station was withdrawn.

The applicant proposes to undertake the East River Wetlands Enhancement Project to preserve and enhance shore area wetlands and provide additional recreational activities, including: construction of approximately 0.41 acres of semi-submerged islands, 0.7 acre of shoreline ponds; 300 foot long breakwater/jetty with stone path; fishing and wildlife observation areas; floating docks; car top boat launch and 5300 cubic yards of dredging in the existing boat basin; along with wetland plantings, management of native species including exotic species management. The project is located within NYS Freshwater Wetland BW-2, a Class I wetland, on the east shore of the Niagara River.

The Department has prepared fact sheets and a draft permit, # NY- 0258644, and made a tentative determination to approve this application for the discharge of storm water which collects in containment vessels for above ground petroleum product storage tanks and for treated sanitary wastewater which is discharged to groundwaters from a service center - market. The storm water is treated by passage through a 1200 gallon oil & sediment separator tank before being discharged to surface drainage ditches flowing to a tributary of Ransom Creek. The NOCO wholesale/retail petroleum distribution facility is located at 13613 Main St., junction of Main & Murray Corners Rd, Newfane.

The permit proposes discharge sampling requirements, best management practices for the facility, and signs identifying the surface discharges. The permit application, draft permit, and applicable regulations are available for review at the Region 9 Headquarters during regular office hours.

The applicant proposes to transport and dispose of septage by land application on 17.5 acres of land owned by Robert Pratt at 9350 Lake Road approximately 1/4 mile east of the interseection of Burgess Road in the Town of Somerset. Septage will be incorporated into the soil within 24 hours after spreading.
