Project Description:

In response to an application submitted by the applicant, the DEC has prepared a Draft Title V Facility Permit and expects to issue a Final Title V Facility Permit, for the applicant's existing High Acres Landfill & Recycling Center facility, located at 425 Perinton Parkway, Town of Perinton, Monroe County. The only Emission Unit at the facility is identified as E-U0001. E-U0001 is composed of the landfill, the landfill's decomposition gas collection system(Process 006), and the control devices for the decomposition gases. The decomposition gases generated by the landfill are controlled by combustion in four (4) internal combustion engines (Processes 001-004) and a utility Flare (Process 007). A backup flare (Process 005) will be used when the utility Flare or one or more of the internal combustion engines are non-operational due to repair or maintenance. The control engines are used to generate electricity which is distributed in the local power grid. The facility's Potential to Emit Carbon Monoxide exceeds the applicability threshold of 100 tons per year for a major stationary source, therefore meeting the requirement for having to obtain a Title V Facility Permit. Emissions from this facility are controlled in accordance with several State Air Pollution Control regulations (6NYCRR Parts 200, 201, 202, 211, 212, 215, and 227) and Federal Air Pollution Control Regulations ( 40 CFR 60, NSPS Subpart A, 40 CFR 60.750, NSPS, Subpart WWW, and 40CFR 61.154, NESHAP Subpart M). The application, Draft Permit, supporting materials, and regulations are available for review at the Region 8 NYSDEC office. Written comments must be filed at the Region 8 Office by the date indicated below. If comments raise significant issues, the DEC may hold a public hearing and/or modify the Draft Permit. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c)(1), the Administrator of EPA has the authority to bar issuance of any Title V Facility Permit determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. After the comment period, EPA will have an additional 45 days for review of the Proposed Title V Facility Permit, which is the Draft Permit with any changes that have been made as a result of public comments received during the public comment period and/or hearing. After EPA review, DEC may issue the Proposed Permit as a Title V Facility Permit if EPA has raised no objection.

Project Description:

The Department proposes to grant the request of Seneca Meadow, Inc. (SMI) to increase the approved design capacity of 4,700 tons per day to 6,000 tons per day (25 % increase). The "approved design capacity" is defined as the average daily tonnage to be received at the solid waste management facility during the quarter in which the most waste is anticipated to be received, as approved by the Department. An average daily tonnage allows for the inherent variability in waste acceptance volumes at solid waste management facilities. As such, SMI demonstrated that they can operate in accordance with their permit when 6,000 tons or more of waste were received. The proposed modification does not include any changes to the landfill design or any other permit conditions. SMI has provided acceptable documentation which demonstrates that the facility can accommodate the proposed tonnage increase and therefore maintain compliance with the existing permit conditions. Specifically, SMI has demonstrated that they can adequately maintain operations for odor control (including landfill gas collection and treatment system maintenance and capacity, daily cover, odoriferous waste screening, and odor complaint management plan), storm water management, traffic control, truck idling, litter control, and leachate management. The proposed modification is estimated to reduce the site life by approximately 2 years. The Department has conducted a coordinated SEQR review and has issued a Negative Declaration. The application materials and SEQR documentation are available for review and comment at the regional NYSDEC office.

Project Description:

In response to an application submitted by Corning Inc, the Department has prepared a Draft Title V Facility Permit for existing processes at the Corning Fallbrook Plant, located on Tioga Ave in the City of Corning, Steuben County. The facility manufactures borosilicate, alumina silicate, and lead glass for tubing, electron gun necks, and cullet production. It has emission points exhausting: batch mixing and raw materials handling operations, including handling of lead monoxide; operations crushing glass tubing into cullet; glass grinding and screening operations; cutting kiln operations and glass melt tanks; glass production; etching and stripping processes; and lens production. In addition to specific emission points, there are fugitive emissions from glass tubing cutting and flaring operations, and from cullet storage bins.

                                        

The Facility meets the definition of a major stationary source, and is required to obtain a Title V Facility Permit as specified in 6 NYCRR Part 201-6, due to potential emissions in excess of the following Title V thresholds specified in 6 NYCRR Part 201-2 and Title V of the Clean Air Act: 100 tons per year each of: oxides of nitrogen (NOx), particulates, and particulates smaller than 10 microns (PM-10) in excess of 100 tons per year each; total hazardous air pollutants (HAP) in excess of 25 tons per year; and individual HAP compounds hydrogen fluoride (HF) and hydrogen chloride (HCl) in excess of 10 tons per year each.

The application also seeks to maintain an existing Part 212 NOx RACTcap, which restricts emissions of NOx from cutting kiln operations and glass melt tanks, to 373 tons per year, and 2.04 tons per day.

The application and Draft Title V Facility Permit are available for review at the Region 8 NYSDEC office. If comments raise significant issues, the Department may hold a public hearing and/or modify the Draft Permit. In accordance with 6NYCRR Parts 621.5(d)(9) and 201.6.4(c)(1), the Administrator of EPA has the authority to bar issuance of any Title V Facility permit determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. After the comment period, EPA will have an additional 45 day period for review of the Proposed Title V Facility Permit, which is the Draft Permit with any modifications after public comment and/or hearing. If EPA does not raise an objection the Department may then issue the Title V Facility Permit.
