Project Description:

In response to an application submitted by Luster-Coate Mettallizing Corp, the Department has prepared a Draft Title V Facility Permit, and expects to issue a Title V Facility Permit, for existing processes at the Luster-Coate - Churchville Facility, located at 32 East Buffalo St. in the Village of Churchville, Town of Riga, Monroe County. This plastic part coating facility vents emissions from vacuum coating operations, paint spray booth operations, drying ovens, and ultraviolet cured coating booth operations. It is a Major Stationary Source, and is required to obtain a Title V Permit as specified in 6 NYCRR Part 201-6, due to potential emissions in excess of 6 NYCRR Part 201-2 and Title V thresholds of 50 tons per year of volatile organic compounds (VOC), 25 tons per year of total hazardous air pollutants (HAP), and 10 tons per year of individual HAP compounds.

The application includes the addition of a thermal oxidizer for reduction of VOC and HAP emissions, as specified in a consent order signed by Luster-Coate and the Department. Compared to previous operations, an incremental increase in potential emissions of oxides of nitrogen (NOx) will occur as a result of thermal oxidizer operation, which will be offset by significant reductions in potential emissions of VOC and HAP.

The application, Draft Permit, supporting materials, and regulations are available for review at the Region 8 NYSDEC office. Written comments must be filed at the Region 8 Office by the date indicated below. If comments raise significant issues, the Department may hold a public hearing and/or modify the Draft Permit. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c)(1), the Administrator of EPA has the authority to bar issuance of any Title V Facility Permit determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. After the comment period, EPA will have an additional 45 days for review of the Proposed Title V Facility Permit, which is the Draft Permit with any modifications after public comment and/or hearing. After EPA review, the Department may issue the Proposed Permit as a Title V Facility Permit if EPA has raised no objection.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Mar 19 2001.

Project Description:

The applicant proposes to expand an existing five acre sand and gravel mine to ten acres. The mine will operate as a traditional surface excavation of sand and gravel above the local water table. The mine will produce an estimated 18,750 cubic yards per year of aggregate sand and gravel over the anticipated four year operational life of the facility. Final reclamation will restore the site to open meadow. The project is located on Wolcott Road (CR 225) in the Town of Rose, Wayne County. Application materials are available for public review and comment at the Regional Office of NYS DEC.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency: NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
