Project Description:

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments, and has made a tentative determination to approve this permit for the applicant's existing landfill, located on Rapp Road, in Albany, New York. The facility is an existing landfill that includes four engines burning landfill gas to generate power, and one large utility flare to combust landfill gas. Emissions from this facility are controlled in accordance with multiple State (Parts 201 and 212) and Federal regulations (40 CFR 60.750, Subpart WWW). The draft permit and application are available for public review at the Region 4 Office. In accordance with 6NYCRR Parts 621.6(d)(9) and 201-6.1(c), the administrator of the US Environmental Protection Agency (USEPA) has the authority to bar issuance of a Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Mar 9 2001.

Project Description:

This Department has received an application from Mohawk Paper Mills, Inc. for modification to an existing air pollution control permit for emission unit P-NYC01, a stationary combustion unit located at 465 Saratoga St., Cohoes, NY.

The applicant has proposed to accept a cap on emissions of carbon monoxide (CO), sulfur dioxide (SO2), particulate matter less than 10 microns (PM10), oxides of nitrogen (NOx), volatile organic compounds (VOC), and hazardous air pollutants (HAP) which will restrict the potential to emit of the facility to a level which is less than the applicability threshold for Title V. These levels are: 100 tons per year for CO, SO2, PM10, and NOx; 50 tons per year for VOC; and 25 tons per year for HAP. By accepting these state and federally enforceable limits, Mohawk Paper Mills, Inc. will not be subject to this regulation.

The applicant has agreed to permit conditions which will limit emissions of the above contaminants to the above limits through restrictions on the volume and type of fuel used. The permittee will be required to maintain records and report this data to verify compliance with permit conditions and limits.
