Project Description:

The Department has made a tentative determination to approve this application for a new SPDES permit (#NY0264539) for a proposed discharge of 1,300 gallons per day of treated sanitary wastewater into a tributary of Rio Grand, a Class D waterbody, from a proposed new surface water discharge treatment system. The new treatment system will replace an existing subsurface system which is failing. Portions of the proposed treatment system will be within the 100 foot adjacent area of NYS Freshwater Wetland GO-33 located at the applicant's automobile dealership on the north side of Route 17M, west of the Village of Goshen. A draft permit is available for inspection and comment at the Region 3 office.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Project Description:

     The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application for Spraylat Corporation located in the City of Mount Vernon, Westchester County, New York.

     This is a Title V Application for an existing Paint Manufacturing Facility, Standard Industrial Classification Code (SIC) 2851, operating in two (2) buildings located at 716 South Columbus Avenue and 117 Anderson Avenue. The facility mixes water-based, solvent based and hi-solids coatings used in many industries. The facility has the Potential to Emit (PTE) more than 25 Tons Per Year (TPY) of Volatile Organic Compounds (VOC) and Hazardous Air Pollutants (HAP) and as such is subject to the Title V permitting requirements of Part 201-6. The facility is also subject to the Reasonably Available Control Requirements (RACT) of Part 212 and as such has taken measures to minimize VOC emissions by installing covers on paint mixing tanks containing VOC's, employing submerged-fill techniques when filling said mixing tanks and installing conservation vents (pressure-vacuum valves) on underground solvent storage tank vents.

     By acceptance of this permit, the permittee agrees that the permit is continent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

     In accordance with 6NYCRR Parts 621.5(d) and 201-6.4, the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act of 6NYCRR Part 201.

     The Application and Draft Permit are available for review at the Regional Office of the NYSDEC.

The Department has made a tentative determination to approve this application for a new permit for a surface discharge of approximately 10 gallons per day (gpd) of treated industrial wastewater from an oil/water separator into an existing storm drain with discharge to a tributary to Katonah Brook, Class C, from vehicle maintenance operations at the Katonah Elementary School Garage. The project involves installation of an oil/water separator and connecting existing floor drains to the separator unit. The Katonah Elementary School Garage, operated by the Katonah-Lewisboro School District, is located on Huntville Road west of Bedford Road (NYS Route 117) in the Town of Bedford, Westchester County.
