NATURAL GAS POLICY ACT NOTICE

On July 14, 2000, the Federal Energy Regulatory Commission issued a final Rule (Order 616) in Docket No. RM00-6-000 reinstating wellhead determination procedures under the Natural Gas Policy Act of 1978. Order No. 616 reinstates the procedures for Section 107 wellhead gas that qualifies for a tax credit under Section 29 of the Internal Revenue Code.

In accordance with an agreement between the New York State Department of Environmental Conservation and the Federal Energy Regulatory Commission: under the authority of งง3-0301(1)(w), 3-0301(2)(d) and 3-0301(2)(j) of the New York State Environmental Law and Sections 503(c) and described in 503(a) of the Natural Gas Policy Act of 1978 (P.L. 95-621), notice is hereby given that the following operators have filed a complete application seeking a determination for tight formation gas under NGPA Section 107 to be eligible for a tax credit under Section 29 of the Internal Revenue Code for the gas produced from the indicated well. Any person may review the application at the office of the Division of Mineral Resources located at 50 Wolf Road, Room 290, Albany, NY, telephone number (518) 457-3682. Comments on any application must be submitted in writing to the Division at the above address on or before the indicated date, stating the precise grounds of support for, opposition to, or other interest in the application.

City Governments and not-for-profit organizations
Development of urban forestry master plans, and implementation of forestry work prescribed in existing urban forestry management plans.

Applications will be accepted through February 28, 2001, for development and implementation of comprehensive urban forestry management plans. Grants are available to city governments in New York State, with a population of 65,000 or more people as reported in the 1990 census. A total of $150,000 in grant funds will be awarded.

Individual grants will not exceed $25,000. All grants must be matched at least equally (dollar for dollar) with non-federal, non-state source funds. This match may include in-kind donations, volunteer assistance, and private and public non-federal contributions. Eligible cities may submit two grant applications: an application for either Development of a Management Plan or Implementation of an Existing Management Plan. Qualifying cities may also submit an application for the third category, Development of a Community-Based Management Model. Funds will be distributed on the following schedule:

$50,000 will be awarded for development of urban forestry management plans.
$75,000 will be awarded for implementation of formally adopted urban forestry management plans.
$25,000 will be awarded for development of an urban forestry community-based management model.

Public Notice of Extension of Comment Period on Proposed Rulemaking

On November 15, 2000, pursuant to Environmental Conservation Law (ECL) Sections 1-0101(1), 1-0303(19), 3-0301(1), and 27-0501, the Department of Environmental Conservation gave notice of the following proposed rulemaking action:

A Proposed Rulemaking was filed with the Department of State on October 27, 2000 to regulate the disposal of the radioactive wastes generated by the extraction or concentration of uranium or thorium, where such waste is not regulated by the U.S. Nuclear Regulatory Commission. The primary source of these wastes is sites where uranium and thorium were refined during and shortly following World War II. Under this amendment, these wastes must be disposed of as radioactive waste and in accordance with Part 380.

The comment period (originally scheduled to close on January 17, 2001) has been extended to 5:00 pm, January 31, 2001.

Clean Water State Revolving Fund (CWSRF) for Water Pollution Control First Quarter Update of the FFY 2001 Intended Use Plan (IUP)

The 2001 IUP for the CWSRF was issued in September 2000. Since that time, municipalities have requested funding for additional projects. Municipal water quality protection projects must be included in the IUP to receive low interest rate loans.

The New York State Environmental Facilities Corporation (EFC) and the Department of Environmental Conservation (DEC) have prepared the final First Quarter Update of the 2001 CWSRF Intended Use Plan. The First Quarter Update will provide interested parties with new and updated information regarding projects listed in the 2001 IUP Annual and Multi-Year Project Priority Lists (PPL).

A notice regarding the draft First Quarter Update was published in the December 27, 2000 issue of the Environmental Notice Bulletin (ENB). Comments were accepted until close of business Friday, January 12, 2001. No public comments were received that necessitated revision of the Update. Therefore, the First Quarter Update to the 2001 CWSRF IUP is final.
