The applicant proposes to construct two concrete seawalls: 89' on the north end and 76' on the south end, of his property on Cayuga Lake, located at 1021 Clearview Road (Fire Lane #6, at the end of Honoco Road, King Ferry.

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Clean Air Act Amendments, and made a tentative decision to approve this permit for the Quest International existing food products facility, located at 158 State Highway 320, Norwich, NY. This facility consists of three natural gas or number 2 oil fired boilers, digestion tanks, various dump stations, mixing tanks, product filters, evaporators, dryers, and a toluene recovery system, scrubber and fabric filters for air pollution control.

Emissions from this facility are controlled in accordance with multiple State and Federal regulations. Additionally, the draft permit has enforceable conditions which limit (cap) the annual emissions of volatile organic compounds (VOCs) and sulfur dioxide emitted from the facility to below the applicability threshold of 6 NYCRR Part 212.10, and 40 CFR 52.21 respectively. The facility is required to maintain records which verify the facility's actual emissions of VOCs and sulfur dioxide, and report this data to the Department. In accordance with 6 NYCRR Parts 621.6(d)(9) and 201-6.1(c), the administrator of the EPA has authority to bar issuance of this permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC Region 7 sub-office, 1285 Fisher Avenue, Cortland, NY. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing Notices will contain instructions on filing for party status and submitting comments.

The applicant proposes to construct a 154, 450 sq. ft.commercial retail facility for a Wal-Mart Supercenter on 34 acres of a 44 acre parcel located on the North side of NYS Rt. 49 west of NYS Rt. 81 in the Village of Central Square. The project includes permanent filling of 1.2 acres of Federal jurisdiction freshwater wetland, and mitigation in the form of purchase of an adjacent 22 acre parcel for a 2.5 acre conservation easement of NYS freshwater wetland, and construction of 1.39 acres of wetlands adjacent to the remaining wetlands.

The Department has made a tentative determination to approve this application for discharge of stormwater and process wastewater to the Salmon River from the Fulton Boiler Works, located on Port & Jefferson Streets in Pulaski, NY. The discharge is through existing outfall pipes and is determined to meet water quality standards. A copy of the application and draft permit is available for review from the Region 7 Office.
