The applicant proposes to place rock rip-rap along an additional 75 feet of shoreline at her property on Lower Chateaugay Lake to protect it from further erosion. Last year the Department issued a permit to Ms. Hanley that authorized placement of up to 100 cubic yards of rip-rap along a 95 foot section of her shoreline. This application represents a continuation of that shoreline protection. The property is located off Route 374 just to the northwest of The Narrows.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and made a tentative determination to approve this application for an Air Title V Facility permit for existing sources that will become classified as major sources of air emissions due to an increase in production and hours of operation. Volatile Organic Compounds(VOC's) will be increased by 49.5 tons over the baseline emissions for 1998-1999. No additional sources are planned at this time.The existing leather finishing operations consist of spray booths and dryers as well as various exempt and trivial activities. Emissions from the leather finishing operations are identified as Emission Unit-FINISH. The facility will limit emissions of VOC's to a cap of 97.09 tons per year to avoid New Source Review applicability under 6NYCRR Part 231. The facility will be subject to the Federal requirements of 6NYCRR Parts 200, 201, 202, 211, 215 and 231. Emission Unit-FINISH is subject to the federal requirements of 6NYCRR Parts 212 and 228. Emissions from the facility include particulates, sulfur dioxide, oxides of nitrogen, carbon monoxide, VOC's and hazardous air pollutants including formaldehyde, cumene, ethyl benzene, ethylene glycol, 2-butoxyethanol, triethyamine, ethyl acrylate, hexamethylene-1, 6-diisocyanate and xylene. The application, draft permit and relevant materials are available for review at the Warrensburg DEC office. Comments of support or objection may be made by filing a written statement prior to the comment deadline. DEC may schedule a public hearing based upon the nature and scope of any issues raised. Hearing notices will contain instructions on filing for party status and submitting comments. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c) the administrator of the United States Environmental Protection Agency has the authority to bar issuance of any Title V facility permit if it is determined not to be in compliance with applicable requirements
