The applicant proposes to undertake the following activities requiring DEC permits on a 1000 + acre parcel bordered by Connecticut to the east, N. Quaker Hill Road on the north and west and Meeting House Road on the south:

- Protection of Water (dam construction): to construct two earthen dams for the purpose of enlarging Brady Pond from 2.5 acres to 12.5 acres.

- Protection of Water (stream disturbance): to construct a 10 foot high fence and temporary road crossings across two protected streams (Conn. 12: Class "B" and Conn. 14: Class "C(TS)"),

- Water Quality Certification: to modify approximately 6000 linear feet of Saw Mill Brook (Class "C" section) to improve trout habitat and to modify 1.76 acres of federal wetlands in conjunction with the enlargement of Brady Pond (approximately 2.64 acres of new wetlands are proposed to be constructed as mitigation).

The overall project includes the construction of a single family residence, an 8 to 10 horse equestrian facility and a State licensed deer farm. A small portion of the overall site is located within the New York City Watershed.

Project Description:

The Applicant, Southern Energy Bowline, L.L.C., proposes to construct and operate Bowline Unit #3, a combined cycle electric generating facility consisting of three combustion turbine generators (CTG), three heat recovery steam generators (HRSG), one steam turbine generator (STG) and associated balance-of-plant systems and facilities. The primary fuel will be natural gas and low (0.05 percent) sulfur fuel oil will be used for back-up. The nominal electric generating capacity of the proposed Facility will be approximately 750 megawatts (MW). The proposed facility will be located adjacent to two existing power facilities, Bowline Units #1 and #2, off of Samsondale Avenue in the Town of Haverstraw, Rockland County, New York, on part of a 257 acre parcel owned by the applicant.

The applicant, as part of this project, proposes to withdraw 7.5 MGD (million gallons per day) maximum (average 6.5 MGD) from the Hudson River via an intake structure proposed to be located in Bowline Pond. Wastewater will be discharged to an on-site collection system and then to the Hudson River via a new discharge diffuser. Storm water run off will be discharged to onsite drainage detention areas and will outfall to Minisceongo Creek. Sanitary wastewater will be routed to existing treatment facilities on the site.

Pursuant to 6NYCRR Part 201, Southern Energy has opted to obtain a preconstruction permit and certificate to operate which will authorize the construction and operation of the proposed Bowline #3 facility, pursuant to 6 NYCRR Subpart 201-6.1, prior to obtaining a Title V permit. The Department has made a tentative determination to approve this air application and a draft permit is available for review.

A public hearing related to this permit has been scheduled for February 21, 2001 and an issues conference is scheduled to begin on March 6, 2001. Southern Energy has also applied for a Prevention of Significant Deterioration (PSD) pre-construction permit pursuant to 40 CFR 52.21. The draft conditions applicable to this PSD permit have been previously subjected to public notice in the ENB on November 15, 2000 and these draft conditions have been incorporated into the Part 201-6 permit currently under review.
