The Department has prepared a Draft Permit and has made a tentative determination to approve this application. The existing facility located at 170 Buffalo Ave., Brooklyn 11213 is a general medical hospital that operates six steam boilers, two natural gas combustion engines for the production of electricity and one ethylene oxide sterilizer. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments. Certification reports submitted by the facility are also available for review. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The applicant proposes to construct 13 two-story semi-attached houses. One of the proposed houses, roadway and a 70 foot wide cul-de-sac is within the adjacent area of NYSDEC regulated Freshwater Wetland NA-9 (Dongan Hills). To access an existing sanitary sewer line on Hunter Avenue, a sewer easement through the adjacent area will be excavated and restored with plantings. A buffer area will be maintained between the rear yard and the wetlands. State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
