     The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit. DEC has made a tentative determination to re-issue this permit for a five-year period, maintaining the current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of 6,000 gallons per day of treated sanitary waste to the Bidwell Creek.

     Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the NYSDEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person.

Project Description:

The applicant proposes to modify the mining plan for the existing dolomite limestone quarry on Blair Road. The modification consist of the addition of 12.7 acres to the Life of Mine Area, including 3 new acres to be added along the eastern property line and 9.7 acres which have been previously used for overburden and stockpile areas at various locations throughout the property. The final grade of the side slopes of the mine are proposed to be changed from a 3 horizontal on 1 vertical slope to a 1.5 horizontal on 1 vertical slope. Groundwater monitoring wells along the eastern property line will be relocated as a result of the addition to the Life of Mine in that area. No changes in the method of mining is proposed. The new Life of Mine area will be increased to 94.6 acres as a result of this modification. The project is locted within the Town of Shelby, Orleans County. Application materials are available for public review and comment at the Regional Office of NYS DEC.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
