Project Description: The Lovett Generating Station is an existing facility owned and operated by Southern Company located in the Town of Stony Point, Village of Tompkins Cove, Rockland County, New York. The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application. The facility consists of the following sources of air emissions: a 727 mmBTU/hr Combustion Engineering boiler (Boiler No. 3), a 1816 mmBTU/hr Foster Wheeler boiler (Boiler No. 4), a 1986 mmBTU/hr Babcock & Wilcox boiler (Boiler No. 5), a fly ash management activity and a coal handling and processing activity. Boiler No. 3 fires No. 6 fuel and natural gas. Boilers No. 4 and No. 5 each fire natural gas, No. 6 fuel or coal and are equipped with Electrostatic Precipitators to control particulate emissions. All three boilers generate steam for electric production. The Standard Industrial Classification Code representative of this facility is 4911-Electric Services. The Lovett Generating Station boilers No. 3 , No. 4 and No. 5 are affected units subject to the Acid Rain Program under Title IV of the Clean Air Act. The facility is subject to NOx RACT requirements under 6 NYCRR Part 227-2, sulfur in fuel limitations under 6 NYCRR Part 225-1, fuel composition and use for waste oil under 6 NYCRR Part 227-2, the NOx Budget program under 6 NYCRR Part 227-3, General Process Emissions under 6 NYCRR Part 212 and Standards of Performance for Coal Preparation Plants under 40 CFR 60 Subpart Y. All three boilers are included in the NOx system wide averaging employed by Southern Company Inc. The facilities potential air emissions for particulate matter, sulfur dioxide, carbon monoxide, nitrogen oxides and combination of hazardous air pollutants exceed the major source pollutant thresholds listed in 6 NYCRR Subpart 201-6. Therefore, the facility is subject to the provisions of Title V. By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit. In accordance with 6NYCRR Parts 621.5(d) and 201-6.4, the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act of 6NYCRR Part 201.
