Project Description:

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and has made a tentative determination to approve this application for the applicant's existing sludge incinerators located at 600 Bergen Avenue, West Babylon, New York. The facility is engaged in the treatment of waste water and sewage sludge incineration. The facility is equipped with two (2) multiple hearth incinerators using No. 2 fuel oil, treatment tanks and filters, settling tanks, aeration tanks, clarifiers, etc. The incinerators are connected to thermal afterburners, spray towers, venturi scrubbers, impingement plate scrubbers and I.D fans. The facility has two small boilers with 40 mmbtu/hr capacity each operating only one at any time. Regulated processes to be authorized under this permit consist of two multiple hearth incinerators, boilers, liquid and solid open processes processing up to 30.5 million gallon per day (mgd) of waste water, ash silo exhaust and the packed bed scrubber for treatment of gases from sludge conditioning using hypochlorite at an alkaline pH to remove trace organics. The facility is subject to 6 NYCRR Part 225, 227 and 40 CFR Subpart O. The Application, Draft Permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing Notices will contain instructions on filing for party status and submitting comments. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The Department has prepared a draft permit and made a tentative determination to approve this application pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) - Air State Facility Permit. The application, draft permit, and relevant supporting materials and regulations are available for review during normal business hours at the NYSDEC Region 1 office.

The facility consists of existing 3 dual fuel fired boilers and newspaper lithographic printing operation at 235 Pinelawn Road, Melville, NY 11747. The facility is proposing restricting the potential to emit its oxides of nitrogen emission through enforceable permit conditions which will cap oxides of nitrogen emissions at 24.5 tons per year, which is below the 25 tons per year applicability threshold for Title V. By accepting these state and federally enforceable limits, the facility will not be subject to Title V requirements.

The applicant has agreed to permit conditions which will limit emission of oxides of nitrogen to 24.5 tons per year through fuel usage and/or hours of operation. The permittee will be required to maintain records and report data to verify compliance with the permit conditions.

The Department intends to issue the permit at the conclusion of the public comment period, unless comments are received which raise significant issues that have not been addressed.
