The draft Title V permit includes conditions from the original Permit to Construct for the incinerator, boilers and the sterilizer based on 6 NYCRR Part 201-Permits, 6 NYCRR Part 212-General Process Emission Source, 6 NYCRR Part 219-3 Infectious Waste Incinerator Facilities, 6 NYCRR Part 225-1 - Fuel Sulfur Limitations, 6 NYCRR Part 227-Stationary Combustion Installations and 6 NYCRR Part 617-State Environmental Quality Review Act(SEQRA). Based on the Compliance Schedule included in the draft permit, the facility will be subject to federal regulation 40 CFR 60,Subpart Ce (Emissions Guidelines and Compliance Time for Hospital/Medical/Infectious Waste Incinerators). Where these regulations overlapped, the permit contains the most stringent limits,which includes emissions limits,monitoring conditions and record keeping requirements. Additionally, to fulfill an existing permit requirement, the Department has revised the mass emission limits for trace metals, organic compounds and hydrogen chloride based on a post construction air quality dispersion modeling using actual measured stack emission rates. In accordance with 6 NYCRR Part 621.6(d)(9),the Administrator of USEPA has the authority to bar issuance of any Title V facility permit if it is determined not to be in compliance with applicable requirements of Clean Air Act or 6 NYCRR Part 201. DEC may schedule a hearing based upon an evaluation of the nature and scope of any written objections raised.
