The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Clean Air Act Amendments, and made a tentative decision to approve this permit for the Bay Park Sewage Treatment Plant used to treat residential wastewater from a portion of Nassau County, New York.

Air emissions from this facility are controlled in accordance with multiple State and Federal regulations. In accordance with 6 NYCRR Parts 621.6(d)(9) and 202-6.1(c), the Administrator of the USEPA has the authority to bar issuance of this permit if it is to be determined to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC Region 1 Office, Building 40, SUNY Stony Brook, NY. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for part status and submitting comments.

The applicant proposes to close and fill a 10' X 13' boat slip, in addition to renovation/ replacement of existing bulkheads, floats and piles. Dredging to 4 feet deep at mean low water will take place in an area no more than 10 feet seaward of the bulkhead. 175 cubic yards of spoil will be used as backfill. The project is located at 86 President Street, Freeport, NY.

The applicant proposes to increase the permitted capacity of medical waste processed at the Biosystems Farmingdale facility from 120 tons per month to a maximum of 468 tons per month. Processing will occur in two existing steam sterilization, vacuum autoclave units. None of these modifications will result in an increase in the maximum hourly emission rate, however, hours of operation will be increased from Monday - Friday 7:00am to 11:00pm to 24 hours per day, 7 days per week. This application also includes modification of transfer operations of intact containers and boxes to a maximum of 1095 tons per month, modification of waste transfer operations to include waste from other 3rd party permitted transporters, and permission to autoclave up to 100 pounds of soil specimens per month.

The applicant proposes to subdivide a 3.2 acre parcel into 2 lots and develop each lot with a single family dwelling, septic system, driveway, deck, wood walkway, and dock with mooring poles. The project is located on the s/s/o Shore Drive, 205' w/o Fern Place, Oakdale, Town of Islip, Suffolk County.

The Department has made a tentative determination to approve a new permit for the discharge of 15,000 gallons per day of sanitary waste to groundwater (septic system). The proposed facility is senior housing. The proposed facility is located in a sole source aquifer and the following water purveyor has been identified as having a service area within 3 miles; Suffolk County Water Authority & Brentwood Water District. The project is located on 2nd Ave. 1200 feet east of Brentwood Road in the locality of Brentwood, Town of Islip, Suffolk County.

The Department has made a tentative determination to approve a new permit for the discharge of 15,000 gallons per day of sanitary & kitchen waste treated via a Cromoglass system to groundwater (septic system). The proposed facility is a hotel. The proposed facility is located in a sole source aquifer and the following water purveyors have been identified as having a service area within 3 miles; Suffolk County Water Authority, Brentwood Water District, and the Smithtown Water District. The project is located on the South side of Veterans Memorial Highway, 1,164 feet west of Lincoln boulevard in the locality of Hauppauge, Town of Islip, Suffolk County, SCTM # 0500-014-03-11.

Construction of a new simple cycle combustion turbine, electric generating facility. The facility will consist of one GE LM6000 natural gas (only) fired combustion turbine. The facility shall generate 47 megawatts, to provide a source of electric power within an area that is currently limited by supply of reliable power. The Department has drafted a permit pursuant to Article 19(Air Pollution Control) of the NYS Environmental Conservation Law(ECL) and Title V of the federal Clean Air Act Amendments, and made a tentative determination to approve this application for the operation of the applicant's existing one medical waste incinerator, two external boilers and one ethylene oxide sterilizer. The draft Title V permit includes conditions from the original Permit to Construct for the incinerator, boilers and the sterilizer based on 6 NYCRR Part 201-Permits, 6 NYCRR Part 212-General Process Emission Source, 6 NYCRR Part 219-3 Infectious Waste Incinerator Facilities, 6 NYCRR Part 225-1 - Fuel Sulfur Limitations, 6 NYCRR Part 227-Stationary Combustion Installations and 6 NYCRR Part 617-State Environmental Quality Review Act(SEQRA). Based on the Compliance Schedule included in the draft permit, the facility will be subject to federal regulation 40 CFR 60,Subpart Ce (Emissions Guidelines and Compliance Time for Hospital/Medical/Infectious Waste Incinerators). Where these regulations overlapped, the permit contains the most stringent limits,which includes emissions limits,monitoring conditions and record keeping requirements. Additionally, to fulfill an existing permit requirement, the Department has revised the mass emission limits for trace metals, organic compounds and hydrogen chloride based on a post construction air quality dispersion modeling using actual measured stack emission rates. In accordance with 6 NYCRR Part 621.6(d)(9),the Administrator of USEPA has the authority to bar issuance of any Title V facility permit if it is determined not to be in compliance with applicable requirements of Clean Air Act or 6 NYCRR Part 201. DEC may schedule a hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments. The application, supporting materials and a draft permit are available for review at the REgion 1 office.

The applicant proposes to construct 487 linear feet of low profile bulkhead. Regrade approximately 4,550 sq. ft. of exisiting eroded bank face, place 110 cubic yards of clean backfill. Of the 4,550 sq. ft. of eroded bank, approximatley 1,800 sq. ft. is intertidal marsh.will be filled and revegetated. The property is located at Bay Avenue, on Priest's Pond off of Reeves Bay, Flanders.

The applicant proposes to construct a two family dwelling, decks, and two pervious driveways within the 100 foot adjacent area of NYS Regulated Freshwater Wetland SH-59. The proposed septic system is located greater than 100 feet from the freshwater wetland boundary. The project is located at 69 Spring Pond Lane, Southampton Town, Suffolk County Tax Map #900-177-1-32.5.

The applicant proposes to maintenance dredge a 10 foot by 40 foot area to a maximum depth of 4 feet below mean low water. Twenty five cubic yards of the dredged material will be utilized as fill on the upland and the remaining 50 cubic yards of material will be removed to an approved upland location. The project is located at Elizabeth Lane, Southold Town, SCTM #1000-78-5-2.

The applicant proposes to maintenance dredge a 10 foot by 215 foot area to a maximum depth of 4 feet below mean low water. Twenty five cubic yards of the dredged material will be utilized as fill for the upland and the remaining 75 cubic yards of material will be removed to an approved upland location. The project is located at Elizabeth Lane, Southold Town, SCTM #1000-78-5-3.
