Project Description:

The Department has prepared a Draft Permit and made a tentative determination to approve this original Air State Facility Permit which authorizes a modification of the Applicant's emission control practice. The Tonawanda Coke Corporation is a merchant byproduct facility producing metallurgical foundry coke in one coke oven battery with 60 ovens, located at 3875 River Road in the Town of Tonawanda. The facility consists of 19 emission units but only two emission units, U-COKEB (the coke oven battery and associated charging, pushing, quenching, leaks, and waste heat stack) and U-ACTIF (the actifier which regenerates the sodium carbonate solution in the desulfurizer by removing hydrogen sulfide), are involved in this permit modification.

The proposed modification would permanently shut down the actifier to achieve a significant reduction in H2S emissions, up to a maximum of 128 pounds per hour, but this would increase SO2 emissions. Using two different dispersion models, the air quality impacts were determined to be less for the increased SO2 emissions than from the current H2S emissions. Both models show maximum concentrations of SO2 well below the applicable standards even under worst-case scenario assumptions. It has been determined that 40CFR52 Subpart J (Prevention of Significant Deterioration) does not apply to this action because this facility has always been capable of and allowed to use coke oven gas as a fuel.

A State Implementation Plan (SIP) revision request for 6NYCRR Part 214.9(a) will be submitted by the Department to the USEPA for this action. Until the USEPA either approves or rejects the SIP revision, Tonawanda Coke will be required to retain the actifier and any associated equipment in place. The actifier would need to be reactivated if USEPA disapproves the SIP revision.

The Application for ASF permit, Draft Permit, supporting materials, and applicable regulations are available for review, during normal business hours, at the DEC Region 9 Office. If comments or objections to the proposed permit are received, DEC may schedule a future public hearing, and would provide a seperate notice with instructions on participation..

Project Description:

The applicant proposes the mining of gravel and material processing with a portable crusher that has a capacity of less than 150 tons per hour, on 28.5 acres of land. The reclamation objective is agriculture. The site is owned by the applicant and is an existing mine site located north of Genesee Road, approximately 1,300 feet west of the interseciton of Youngers Road. The haulageway is an existing driveway that provides access to Genesee Road.
