The applicant proposes the mining of gravel and material processing with a portable crusher that has a capacity of 50 tons per hour, on 3.35 acres of land. Approximately 2 acres of the site to be excavated is on land owned by Stewart and Roberta Horton, and the remainder, to be used for processing, stockpiling and the haulageway, is on the Conewango Fire Department property. The estimated life of the mine is 5 years. The reclamation objective for the Horton property is farmland and for the fire department property is a lawn. The proposed mine is southeast of Northeast Road, adjacent to and north of the Conewango Fire Department.

The applicant proposes to fill and shape approximately 1,000 lineal feet of eroded streambanks along Tributary 6 of Olean Creek (Fay Hollow Creek) using material removed from gravel bars at the same location. Additionally, the applicant proposes to install a precast block wall along a 100 lineal foot section of reshaped streambank for further protection. All work will occur on the applicant's property that is located approximately 5,000 feet west of the intersection of Fay Hollow Road and NYS Rt. 16.

The Department has made a tentative determination to issue a Department initiated modification for the SPDES Permit for the above referenced Wastewater Treatment Plant. The modification includes substituting CBOD5 for BOD5 values for nitrification, adjustments to Water Quality Effluent Limits, monitoring requirements for metals and a mini pretreament program.
