Project Description:

The applicant proposes to install two new steel utility poles within State-designated Freshwater Wetland MD-19 along an existing utility right-of-way, and to clear trees from about 0.2 acre (50 feet x 170 feet) of the same wetland. The entire project consists of the construction of a 400 megawatt electrical substation and the relocation of about 0.9 mile of an existing 138 kV electricity transmission line to new steel poles. The project is located along the north side of McVeigh Road north of Interstate 84. Installation of the two steel poles will require the permanent fill of about 100 square feet of wetland area.

The Department has made a tentative determination to approve this application to modify a SPDES permit to increase an existing surface discharge (Outfall #002) from 4,000 gallons per day (gpd) to 20,000 gpd of treated process wastewater from the applicant's poultry processing facility into the Middle Mongaup River, Class B(t). The project involves upgrading the facility's wastewater treatment plant to utilize the activated sludge process. The permit is being modified to reflect an increase in production at the facility and includes transferring the permit from AGY Corporation to Hudson Valley Foie Gras, LLC. The project is located near the western terminus of Brooks Road, west of Old Route 17 (County Route 175) in the Town of Liberty, Sullivan County. A draft permit is available for inspection and comment at the regional office.

Project Description:

     The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application for TC Advertising Company, New York Division located in the Village of Saugerties, Ulster County, New York. The facility produces advertising inserts and other printing for commercial use. The emissions are created from the five (5) heatset and nine (9) coldset web offset lithographic presses. The facility emits a number of contaminates such as Volatile Organic Compounds (VOC), Hazardous Air Pollutants (HAP), Oxides of Nitrogen (NOx) and Carbon Monoxide (CO).

     The Standard Industrial Classification Code for this facility is 2752 Commercial Printing Lithographic.

     The NOx and CO emissions are from the catalytic oxidizers which are used to control the emissions of VOC and HAP from the heatset printing operation (Emission Unit L-00002) and to meet the Volatile Organic Compound Reasonable Air Control Technology (RACT) requirements. For the coldset printing operation (Emission Unit L-00001) compliant inks are used to meet RACT.

     Any trimmings or dust from the binding and trimming operations are controlled by blowers and duct work connected to two (2) cyclones with balers (Emission Unit P-00004).

     The facility falls under various state and federal regulations including, but not limited to, 6NYCRR Subparts 201,212 and 234.

     The facility potential air emissions for VOC's exceed the major source pollutant thresholds noted in 6NYCRR Subpart201-6. Therefore, the facility is subject to the provisions of Title V.

     By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

     In accordance with 6NYCRR Parts 621.5(d) and 201-6.4, the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act of 6NYCRR Part 201.

     The Application and Draft Permit are available for review at the Regional Office of the NYSDEC
