U S Gypsum Company has submitted an application for a Title V Facility Permit for its existing Paper Mill Operations, part of U S Gypsum's Oakfield Plant located at 2844 Judge Road in the Town of Oakfield, Genesee County. Paper Mill Operations include emission points for a 71.5 million BTU per hour gas turbine generator, a 65 million BTU per hour process steam boiler, 9 dryer hood exhausts, and fugitive emissions from the paper making process and an industrial wastewater treatment plant. Paper Mill Operations meet the definition of a Major Source in 6 NYCRR Part 201-2.1(b)(21), and are subject to Part 201-6 requirements for a Title V Facility Permit due to potential emissions of oxides of nitrogen (NOx) and carbon monoxide (CO) in excess of 100 tons per year each.

This application seeks to maintain a 6 NYCRR Part 227 oxides of nitrogen (NOx) Reasonably Available Control Technology (RACT) variance granted by the Department in 1997. This variance allows the operation of a cogeneration unit including the natural gas turbine and heat recovery boiler referenced above, without emission control equipment, and is based on the cost of emission control being in excess of the Department's guideline level of $3000 per ton of emissions controlled. The variance restricts total emissions of NOx to 126 tons in any 12 month period, and will be subject to review with respect to any new control technology within the next 2 years, by the end of its first 5 year review period.

U S Gypsum has applied for a separate Title V Facility Permit to cover Gypsum Process Operations at the Oakfield Plant, which will be described in a subsequent public notice at the time that application is determined to be complete.

The application and draft Title V Facility Permit for Paper Mill Operations are available for review at the Region 8 NYSDEC office. If comments are received which raise significant issues or provide additional relevant information, the Department may modify the draft permit. In accordance with 6NYCRR Parts 621.5(d) and 201.6.4(c), the Administrator of the United States Environmental Protection Agency (EPA) has the authority to bar issuance of any Title V Facility permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act or 6NYCRR Part 201. After the public comment period, EPA will have an additional 45 day period for review of the proposed permit, which is the draft permit with any changes due to issues raised by public comments. If EPA does not raise an objection the Department may then issue the Title V Facility Permit.

Pactiv Corporation has submitted an application for a Title V Facility Permit for the Canandaigua Packaging Plant, part of Pactiv's Canandaigua facility located at 5250 North Street in the Town of Canandaigua, Ontario County. The Packaging Plant is an existing polystyrene foam production facility, which includes foam extrusion, thermoforming, and coating operations. It includes emission points for one new and 11 existing foam extrusion lines, 2 extrusion line ovens, a pyrolysis oven for extruder die cleaning, a thermal densifier to collapse foam, silicone and plastic coating operations, and solid and scrap materials handling systems.

This application seeks to maintain a 6 NYCRR Part 212 Volatile Organic Compound (VOC) Reasonably Available Control Technology (RACT) variance granted by the Department previously. This variance allows the operation of foam extruders, thermoforming operations, and foam roll storage operations, without emission controls. The variance is based on low concentrations of slowly released VOC, resulting in costs for emission control significantly in excess of the Department's guideline level of $3000 per ton of emissions controlled.

Based on new information indicating existing control equipment efficiency of 94 rather than 95 percent for reclamation of scrap after thermoforming and trimming, this application also proposes the restriction of material throughput to 2 existing foam extrusion lines, to restrict potential VOC emission levels from each line's processes, including scrap reclamation, to below the 40 ton per year threshold of 6 NYCRR Part 231 New Source Review in Ozone Transport Regions.

Finally, besides previously permitted emission sources, this application also includes the addition of a new foam extrusion line. Restrictions on material throughput are also proposed to limit potential VOC emissions from this new line's processes to below the 40 ton per year Part 231 threshold.

A separate Title V Permit will cover research and development operations at the Technology Center part of Pactiv's Canandaigua facility. The applications and draft Title V Facility Permits are available for review at the Region 8 NYSDEC office. If comments are received which raise significant issues or provide additional relevant information, the Department may modify either or both draft permits.
