Kodak Polychrome Graphics has submitted to the DEC an application for emissions reduction credits ("ERCs"). The requested ERCs are associated with the shutdown of Kodak Polychrome's facility located at 40 Charles Street, Binghamton (formerly Anitec Imaging Products Division), for which Kodak Polychrome has surrendered its permits. The DEC has reviewed the application and made a tentative decision to approve portions of the request, equal to 25 tons of Volatile Organic Chemicals (VOC) ERCs. This approval is being made pursuant to 6 NYCRR Part 231-2.6(a)(7).

     The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit. DEC has made a tentative determination to re-issue this permit for a five-year period, maintaining the current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of 4,000 gallons per day of treated sanitary waste to the Nanticoke Creek.

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Clean Air Act Amendments, and made a tentative decision to approve this permit for the applicant's existing paper coating facility, located at 720 Azon Road, Johnson City, NY. This facility consists of aqueous, solvent and film coated paper coating machines, dryers, mixing vessels, chemical (solvent) storage tanks and two thermal oxidizers for control of volatile organic compound (VOC) and hazardous air pollutant (HAP) emissions.

Emissions from this facility are controlled in accordance with multiple State and Federal regulations. Additionally, the applicant has accepted existing permit conditions which limit (cap) the annual emissions of volatile organic compounds (VOCs) emitted from the no. 24 coating machine to below the applicability threshold of 6 NYCRR Part 231-2. The facility is required to keep records of VOC emissions and to report this data to prove that the facility remains below the applicability threshold of NYCRR part 231-2. In accordance with 6 NYCRR Parts 621.6(d)(9) and 201-6.1(c), the administrator of the EPA has authority to bar issuance of this permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

The Tennessee Gas Pipeline LaFayette Compressor Station facility primarily consists of two Clark model TLAD-10 and one Cooper Bessemer model 10W-330C2 internal combustion compressor engines fired by natural gas. These engines are equipped with low NOx combustor technology for NOx control. Facility operations and permit limits will not change as a result of this Title V permit. In accordance with 6 NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201. The Town of Hastings proposes to allow OCWA to construct approx. 19,700 linear feet of new water main and associated appurtenances to serve up to 42,400 gpd to the Elderberry Lane Water District in the Town of Hastings. The Town, as lead agency, has considered potential impacts to cultural resources and has determined after a Phase I investigation that no impacts are expected. Temporary impacts during construction to state designated freshwater wetland CS-8 will be minimized and considered not significantly adverse. The application is available for review at the DEC Syracuse office and comments will be received for thirty days from the date of this publication.
