Project Description:

The applicant proposes a three lot single family residential development to be known as Oak Tree Park Subdivision with the construction of portion of the houses, driveways and associated landscaping within the 100 foot adjacent area of Freshwater Wetland NA-9, a class II wetland . To offset the loss of wetland adjacent area benefits, the applicant has developed a compensatory wetland mitigation area for lots #1 and #2 and a wetlands buffer planting plan and monitoring program for all three lots. The residual wetlands and adjacent areas located on each lot will be part of a Conservation Easement placed on each deed and dedicated to the Town of Orangetown. Each lot has a connection for municipal water and sewer. The project is located on Lauren Drive, north of Oak Tree Road, west of Route 340, Palisades.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.
SEQR Lead Agency: TOWN OF ORANGETOWN PLANNING BOARD
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES)permit. DEC has made a tentative determination to re-issue this permit for a five-year period, maintaining the current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of 29,700 gallons per day of treated sanitary waste to the Sandburg Creek.

The applicant proposes to construct a driveway and single family residence within the 100-foot adjacent area of New York State designated Freshwater Wetland No. K-28 (Class II). The project site is located on the north side of Jackson Road, about 0.25 mile north of the intersection with Round House Road. The proposed driveway is 12 feet wide. About 300 linear feet of the driveway will be located within the 100 foot wetland adjacent area. Approximatetly 0.3 acre of the 100-foot adjacent area will also be cleared and graded for the construction of the house and lawn.
