The New York State Department of Environmental Conservation (NYSDEC) hereby announces the intent to approve General Electric's Selkirk Operations (GE Selkirk's) trial burn plan, revision #4, dated August 8, 2000. This notice is primarily intended to keep the public informed of GE Selkirk's trial burn status and to provide a brief description of the facility and the affected unit.

FACILITY DESCRIPTION

The GE Selkirk facility is primarily a manufacturer of NorylŪ Thermoplastic materials which have a wide variety of applications in the automotive, electronic and building industries. GE Selkirk operates a boiler, also known as the A/P Hot Oil Heater, which burns hazardous and non-hazardous wastes that are generated on-site. The A/P Hot Oil Heater is equipped with a multi-fuel burner, a hot oil heat recovery system which is used for process control of the phenolic distillation columns, and a heat recovery unit to preheat combustion air. Currently, GE Selkirk's boiler is operated under the Boiler and Industrial Furnace (BIF) interim status standards of 6 NYCRR Part 374-1.8(d).

INTENDED APPROVAL

The NYDEC intends to approve GE Selkirk's August 8, 2000 trial burn plan which will be used to demonstrate the ability of GE Selkirk's boiler to comply with the performance standards of 6 NYCRR Part 374-1.8 (e) through (h). The trial burn data will also form the basis for a multi-pathway risk assessment for the unit. Furthermore, the results from the trial burn and the health risk assessment will be used to establish permit conditions for the boiler to ensure continuous compliance with the performance standards of 6 NYCRR Part 374-1.8 (e) through (h).

PUBLICLY ANNOUNCED INFORMATION

Pursuant to 6 NYCRR 373-1.9(d)(7), the NYSDEC must publicly announce the following information prior to approving GE Selkirk's August 8, 2000 trial burn plan:

4. Schedule of activities that are required prior to permit issuance:

A. The NYSDEC's anticipated approval date of GE Selkirk's August 8, 2000 trial burn plan:

The NYSDEC intends to approve GE Selkirk's August 8, 2000 trial burn plan within one week following the completion of the public notice period. However, if members of the public submit significant information or views relating to GE Selkirk's trial burn plan, the NYSDEC will consider this information in the final approval and may respond in writing at the time of plan approval.

B. Anticipated time periods during which the trial burn will be conducted:

Commencement date: November 1, 2000

Completion date: November 3, 2000

C. Other activities which are required prior to permit issuance:

Review and approval of GE Selkirk's trial burn results, health risk assessment results, and public notice of the draft permit.

Negative Declaration

Albany County - The State University of New York, as lead agency, has determined that the Construction of a new Art Facility/Sculpture Studio will not have a significant adverse environmental impact. The action involves construction of a new 21,000 GSF art facility and sculpture studio. The project is located at the State University of New York, Albany, New York.

Delaware County - The Town of Hamden Town Board, as lead agency, has determined that the Adoption of the Town of Hamden Comprehensive Plan will not have a significant adverse environmental impact. The action involves adoption of the Town of Hamden Comprehensive Plan. The project is located in the Town of Hamden.

Rensselaer County - The Town of Schodack Town Board, as lead agency, has determined that the proposed Local Law No. 3 of 2000 Belt Entertainment Law will not have a significant adverse environmental impact. The action involves the restriction of certain adult uses, such as adult bookstores or peepshows, to areas more than 2,000 feet from restricted use and public areas, such as parks. The project is townwide.

Schenectady County - The Town Board of the Town of Niskayuna, as lead agency, has determined that the proposed removal of professional offices from the R-2 Zone will not have a significant adverse environmental impact. The action involves the removal of the professional office use from the R-2: Medium Density Residential Zoning District. The project is located in the Town of Niskayuna.

Schoharie County - The State University Construction Fund, as lead agency, has determined that the proposed Daycare Center will not have a significant adverse environmental impact. The action involves construction of an approximately 10,000 sq. ft. building. The project is located on the campus of the State University College of Agriculture and Technology at Cobleskill, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Otsego County - The State Education Department, as lead agency, has accepted a Draft EIS on the proposed land acquisition for the Athletic Fields Expansion - Site B in the Edmeston Central School District, SED Project No. 47-05-01-04-0-001-007. Comments are requested on the Draft EIS and will be accepted by the contact person until October 4, 2000. The action involves the purchase of 10 acres of land located on Miller Road (Tax Parcel No. 108-1-11) in the Town of Edmeston.

Notice of Acceptance of Final EIS

Greene County - The Town of Prattsville, as lead agency, has accepted a Final Environmental Impact Statement on the proposed New Sewage Treatment Infrastructure Facilities Program. The action involves the design and construction of a municipal sewage system consisting of a 86,000 gpd wastewater treatment plant and approximately 15,000 feet of collection lines. The project is located on State Route 23, County Routes 7 and 10, in the Town of Prattsville.
