The applicant proposes the mining of gravel with no mechanized material processing, on approximately 7.5 acres of land owned by Chester A. Gosper III. The mine haul road will access Allegany County Route 2. The estimated life of the mine is 8 years and the reclamation objective is agriculture. The site is north of Allegany County Route 2 (Karr Valley Road), about 1,500 feet west of the Route I-86 (Southern Tier Expressway) overpass bridge and 2,100 feet west of the West Almond/Angelica Town line, in the Town of Angelica, Allegany County.

The Department has prepared a Draft Permit and made a tentative determination to approve this modification application for SPDES Permit No. NY-0243108 for proposed additional discharges of 15,100 gallons per day (GPD) of sanitary wastewater, boiler blowdown, softener backwash, and purified water cleaning (Outfall 001), and 8,400 GPD of process wastewater (Outfall 002) into an unnamed tributary to Big Six Mile Creek from a new wastewater treatment plant. Treatment for Outfall 001 consists of septic tank, packaged trickling filter/clarifier, rapid sand filter and ultra violet oxidation, while Outfall 002 is treated by oil/water separation, pH treatment sequencing batch reactor and sand filtration. Currently these existing wastewater streams are treated at a permitted neighboring facility, American Pharmaceutical Partners, Inc. Fujisawa Healthcare, Inc. located at 3125 Staley Road, is a manufacturer of pharmaceutical products. The draft permit contains a short term high intensity monitoring requirement of whole effluent toxicity of sanitary wastewater, a five year toxicity testing program, and preparation of a Best Management Practices Plan. The application and draft permit are available for inspection at the region 9 NYSDEC Office.

The applicant proposes to install riprap streambank protection on Cattaraugus Creek north of their plant on West Main Street in the Village of Arcade. About 700 feet of rock riprap and 25 foot keys at the upstream and downstream ends of the riprap are proposed to be placed on the south bank of the creek.
