Project Description: The New York State Department of Environmental Conservation (DEC) proposes the implementation of additional Corrective Measures (CM) at lands adjacent to the Hudson River and down river of the Ciba/Hercules Main Plant Site. A draft Statement of Basis has been prepared to document the procedures undertaken to arrive at the proposed CM. DEC intends to issue a permit modification for the removal of contaminated soil/sediment from portions of a backwater section of the Hudson River ("Ponded Backwater Area" [PBA]), a former river channel. Ciba/Hercules has agreed to implement the CM to address DEC's concern that cadmium levels in parts of the PBA shallow soil and sediment pose a potential threat to terrestrial and aquatic life. The proposed CM involves removal of approximately 15,000 cubic yards of material (to a depth of 1 to 2 feet) from a 5.4 acre portion of the PBA, for disposal at the adjacent Main Plant Site approved disposal area. The excavated area will be backfilled with clean soil for revegetation. The backwater area extends approximately 2300 linear feet, parallel to Lower Warren Street on either side of the Warren/Washington County line. This Department initiated modification is to the existing Hazardous Waste Management permit issued to Ciba/Hercules.
