Project Description: Based upon a reevaluation of the NYS Water Quality Standards for the segment of the Hudson River where the Newburgh WWTP is located, this Department has made a tentative determination to modify the above referenced State Pollutant Discharge Elimination System (SPDES) Permit as follows: 1) Increase the effluent limit for copper and the action level for zinc. 2) Decrease the action levels for lead and cadmium. Based upon the final report for the City of Newburgh WWTP, as a result of the optimization of the City and Town of Newburgh lead/copper control programs, the optimization of the WWTP activated sludge process and the construction of a third secondary clarifier the revised action levels are attainable. Draft pages 6 and 7 of the above referenced SPDES Permit which incorporates the above modifications and a revised permit fact sheet (page 1-4) have been prepared and are available for review. |

Project Description: The applicant proposes to construct a driveway and install underground utilities within the 100 foot adjacent area of New York State designated Freshwater Wetland PB-58 (Class II) for a single family residence. The project site is located on the east side of Crans Road, about 250 feet south of the intersection with Last Road. Approximately 100 feet of the proposed 14 foot wide driveway will be located within the wetland adjacent area. Within the wetland adjacent area, the underground utilities will be installed in a trench 3 feet deep under the proposed driveway. In addition, a 1.4 acre pasture will be established, of which approximately 0.25 acre will be established within the wetland adjacent area involving the installation of about 550 linear feet of fence. |

Project Description: The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application for the the Metal Container Corporation facility located in the Town of New Windsor, Orange County, New York. The facility manufactures two piece aluminum beverage cans. The emissions are from the cutting and forming of the of the can bodies and the coating and decorating operations. The facility emits a number of contaminates such as Volatilve Organic Compounds (VOC), Hazardous Air Pollutants (HAP) and Oxides of Nitrogen (NOx). The NOx emissions are from the thermal oxidizer for controlling the total VOC releases. The facility capped out of New Source Review by limiting the usage of natural gas to 547.5MMCF per year, which in turn will keep the total NOx emissions below 40 tons per year. The Standard Industrial Classification Code for this facility is 3411- Metal Cans and Shipping Containers. The Frontend Operations (Emission Unit U-1000), includes the formation of the can body. The emissions are from the cutting oils and cleaners from the cupper, bodymaker and washer are uncontrolled and emitted through the buildings general ventilation system. The Backend Operations (Emission Unit U-2000), includes the coating and decorating of the manufactured cans. The coated cans are brought through natural gas fired ovens to assist with the curing time. The emissions from the hot zone (curing ovens), are controlled by a natural gas fired thermal oxidizer. The facility potential air emissions for both VOC's and HAP's exceed the major source pollutant thresholds noted in 6NYCRR Subpart 201-6. Therefore, the facility is subject to the provisions of Title V. By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified any Special Conditions included as part of this permit. In accordance with 6NYCRR Parts 621.5(d) and 201-6.4, the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act of 6NYCRR Part 201. The Application and Draft Permit are available for review at the Regional Office of the NYSDEC. |
