Project Description:
The applicant proposes a 55.6 acre addition to the existing Freedom Gravel Pit, currently permitted for 165 acres. The new area is located west of Cattaraugus County Route 21, opposite the existing mine. A truck crossing of the County Road is proposed, so that mined material can be processed and stockpiled at the existing plant and stockpile area. The estimated life of the new area is five years and the reclamation objective is agriculture. The existing mine is at 2372 Elton Road (Cattaraugus County Route 21 also known as Elton-Delevan Road. The proposed addition is west of Elton Road and north of Lime lake Road (Cattaraugus County Route 36).

Project Description:

Project Description:
The Department has made a tentative determination to approve the application of Buffalo Newspress, Inc. (located at 200 Broadway) a commercial web offset lithographic printer of publications and advertising supplements. The facility operates 5 four color presses, utilizing low volatility nonheatset ink, under a Certificate of Registration with a cap by rule on volatile organic compounds (VOCs) and hazardous air pollutants (HAPs) emissions. This permit modification allows for the use of heatset inks with two of those presses and the addition of one nonheatset ink press. To avoid the requirements of 6NYCRR Subpart 201-6 Title V Facility Permits, a new cap on facility-wide emissions has been established to limit VOC, total HAP and individual HAPs to below the applicability thresholds at 49 tons per year (tpy), 24 tpy and 9 tpy, respectively. A regenerative thermal oxidizer, operated at 1600 degrees Fahrenheit to achieve 99% destruction of VOCs from the heatset inks, shall be used to maintain VOC emissions to below the specified limit. Buffalo Newspress is also subject to the requirements of 6NYCRR234, Graphic Arts, which has an applicability threshold of 50 tpy for VOCs. By accepting a limit on VOC emissions at 49 tpy, Buffalo Newspress avoids the control requirements of 6NYCRR234. Since VOC emissions are less than the major source threshold of 50 tpy specified in 6NYCRR231-2, New Source Review, the facility is not required to conduct an applicability determination for the increase in emissions caused by the modifications. The application and draft air state facility permit are available for review during normal business hours at the regional office.

Project Description:
The proposal is to install a new 36 inch diameter, 40 foot long plastic culvert pipe in unnamed Tributary 16 to East Branch Cazenovia Creek (Class B), to enable construction of a private access road. The stream channel up and down stream of the new culvert is proposed to be excavated up to 300 feet long and three feet deep to restore flow capacity. Additional stream work will take place at an existing culvert crossing downstream where a culvert will be extended by 10 feet and a concrete block headwall will be placed. The property is located on the east side of Lewis Road approximately 1,700 feet south of its intersection with Darien Road.

Project Description:
The Department has drafted modified permit pages and made a tentative determination to modify the Part 373 Permit for Occidental Chemical Corporation's Niagara Plant located at Buffalo Avenue and 47th Street in the City of Niagara Falls. The facility's existing manufacturing operations generate hazardous wastes which are stored in containers and tanks, and incinerated in an on-site incinerator. Pursuant to a Part 373 Permit issued in 1988 and renewed in December 1999, the facility has been receiving, storing and incinerating hazardous wastes generated at other Occidental-owned facilities in western NY and Occidental's Taft, Lousiana facility. In 1997, Occidental requested authorization to incinerate in the Buffalo Avenue facility hazardous waste incinerator the distillate waste (Durez distillate) generated in their Durez Division Plant at Packard Road in the City of Niagara Falls. As part of this request, Occidental conducted a trial burn with Durez distillate as per test protocol approved by the Department. Occidental submitted trial burn and health risk assessment reports documenting the results of this trial burn and the health impacts of the emissions from the facility's incinerator. A review of these reports by Department staff with assistance from the NYS Department of Health indicated that the Buffalo Avenue incinerator met all Part 373 performance standards for hazardous waste incinerators while incinerating the Durez distillate with other organic residues and that its estimated health impacts are within the Department's acceptable threshold. Based on the results of this test, the modification will authorize Occidental's Buffalo Avenue facility to receive, store and incinerate Durez distillate. Project Description:
The applicant proposes to construct and operate, within two existing covered sludge drying bed buildings at the fenced site of the Village of Arcade Wastewater Treatment Plant, a composting operation which would process about 420 cubic yards per year of aerobically digested sludge with wood chips to yield about 529 cubic yards per year of compost. The compost would be produced using the aerated static pile method. The finished compost generated would be classified as a Class 2 compost, suitable for landscaping purposes. The wastewater treatment plant is located on Hurdville Road. The Department has prepared a draft permit, which is available for review, and made a tentative determination to approve this application.
