Project Description:
 NYSDEC has agreed to the applicant's request to modify their existing air permit. The proposed modification will limit facility-wide emissions to a level which is below the applicability thresholds of 25tpy of volatile organic compounds (VOCs), 10 tpy for any hazardous air pollutant (HAP) and 25 tpy for total HAPs. By accepting these state and federally enforceable limits the facility will not be considered a major source for VOCs and HAPs, and will not be subject to the provisions of the Title V operating permit provisions. The applicant has agreed to conditions that will limit emissions of VOCs & HAPs through restrictions on the production of hot asphalt (500,000 tons per year). The permittee will be required to maintain records and report the data to verify compliance with permit conditions. Permit application materials are available for review at the Regional office. Project Description:
 The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the federal Clean Air Act Amendments, and made tentative determination to approve this application for the applicant's existing municipal waste combustor facility consisting of three mass burn waterwall type municipal waste combustor units with nominal design capacity of 250 tons per day. The draft permit includes conditions that originated in the original permit issued in April 1989 which were based on 6 NYCRR Part 201- Permits, federal regulation 40 CFR 52.21 - Prevention of Significant Deterioration (PSD) arose from reviews of PSD of air quality and Best Available Control Technology (BACT), 6 NYCRR Part 231 - New Source Review in Nonattainment Areas arose from review of Lowest Achievable Emission Rate (LAER), and 6 NYCRR Part 617 - State Environmental Quality Review (SEQR). Based on the Compliance Schedule included in the draft permit, the facility will be subjected to federal regulation 40 CFR 60, Subpart Cb (Emissions Guidelines and Compliance Schedules for Municipal Waste Combustors). When overlap occurs, the permit contains the most stringent limits, which includes emissions limits, monitoring conditions and record keeping requirements. This draft permit also incorporates the proposed waste throughput increase from existing 314,814 tons per year to future 350,400 tons per year. This facility, as PSD-affected source, is therefore subject to a modification to any of its federally-enforceable permit restrictions. Based on a higher heating value of 5000 Btu per pound of waste and maximum design flue gas flow rate of 36,632 dry standard cubic feet per minute (dscfm) corrected to 7% oxygen, the applicant demonstrates that the proposed throughput increase will not result any increase in the Potential to Emit (PTE) values as shown in the original PSD Permit Application. The applicant has accepted permit limitations to include maximum annual emissions for oxides of nitrogen (NOx) and Volatile Organic Compounds (VOC) to ensure that this modification will not be subjected to New Source Review in non-attainment areas pursuant to 6NYCRR Part 231-2 under the provision of a Source Project. Additionally, to fulfill an existing permit requirement, the Department has revised the emission limits for trace metals and organic compounds, based on 95 percent confidence intervals calculated from actual measured stack emission rates. In accordance with 6NYCRR Part 621.6(d)(9) the Administrator of USEPA has the authority to bar issuance of any Title V facility permit if it is to be determined not to be in compliance with applicable requirements of Clean Air Act or 6NYCRR Part 201. DEC may schedule a hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments. The application, supporting materials and a draft permit is available at the Region 1 office.
