Project Description:
The Department has received an application for a Title V Facility Permit for existing processes at the Avanti Case-Hoyt Facility, located at 100 Beaver Road in the Town of Chili, Monroe County. This commercial printing facility produces books, magazines, and other items, and has emission points for web and sheet feed presses, press plate production, and adhesive binding operations. This facility meets the definition of a major stationary source, and is required to obtain a Title V Facility Permit as specified in 6 NYCRR Part 201-6, due to potential emissions in excess of the following Title V applicability thresholds specified in 6 NYCRR Part 201-2 and Title V of the Clean Air Act for a Major Stationary Source: 50 tons per year of volatile organic compounds (VOC); 25 tons per year of total hazardous air pollutants (HAP), and 10 tons per year of an individual HAP compound. The application and the Draft Title V Facility Permit are available for review at the Region 8 NYSDEC office. If comments raise significant issues, the Department may modify the Draft Permit. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c)(1), the Administrator of EPA has the authority to bar issuance of any Title V Facility Permit determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. After the comment period, EPA will be provided with the Proposed Title V Facility Permit, which is the Draft Permit with any modifications after public comment. EPA will then have an additional 45 days for review. After 45 days, the Department may issue the Proposed Permit as a Title V Facility Permit if EPA has raised no objection.

Project Description:

Project Description:
The applicant proposes to develop and operate an unconsolidated surface mine for extraction of fill material and clay (Brockport silty clay loam) for remediation of the McKenna Landfill. The mine is located on the Howard property at the intersection of Route 31 and Hindsburg Road in the Town of Murray. Excavation will be by mechanical equipment standard for this type of mining operation. No processing will occur on site. Reclamation will restore the site to an open water surface and will expand an existing 17 acre pond to approximately 25 acres. The life of mine area is 8.5 acres. Application materials are available for public review and comment at the Regional Office of NYS DEC.

THE APPLICANT PROPOSES TO DEVELOP AND OPERATE A 3.97 ACRE SURFACE SAND AND GRAVEL MINE ON HIS 53 +/- ACRE PARCEL ON THE EAST SITE OF NYS ROUTE 350, ABOUT 1800 FEET SOUTH OF NYS ROUTE 31F. THE MINE WILL OPERATE AS A TRADITIONAL SURFACE EXTRACTION OF THE PALMYRA SERIES OF GRAVELLY LOAMS, WHICH IS THE PREDOMINANT SOIL TYPE ON THE SITE. THERE MAY BE SOME PROCESSING (SCREENING/SORTING) ON-SITE OF EXCAVATED MATERIAL. THERE WILL BE NO USE OR PUMPING OF GROUND OR SURFACE WATERS. APPROXIMATELY 100,000 CY OF SAND AND GRAVEL WILL BE REMOVED DURING THE ANTICIPATED 36 TO 60-MONTH OPERATIONAL LIFE OF THE MINE. FINAL RECLAMATION WILL RESULT IN A 3.7 +/- ACRE POND WITH A SAND BEACH. Project Description:
The Department has drafted a Title V facility permit for the applicant's Marion Plant facility located at 3709 Mill St. in the Hamlet of Marion, Town of Marion, Wayne County. The facility manufactures metal cans and cans fruits and vegetables. The draft permit includes two Emission Units: (1) 0-1BOIL, consisting of four dual-fuel (natural gas & No. 6 fuel oil) boilers that provide steam for canning processes; and 0-01CAN, which consists of the processes in the can manufacturing plant. This facility is considered a major stationary source and will need to obtain a Title V permit because it has the potential to emit 50 tons per year (TPY) or more of Volatile Organic Compounds (VOC), 25 TPY or more of total Hazardous Air Pollutants (HAP), and 5 TPY or more of any individual HAP. The permit includes a condition which restricts the facility's potential to emit Oxides of Nitrogen (NOx) to 190,000 pounds or less for any consecutive 12 month period, a restriction which will cap the facility emissions below the applicability thresholds for compliance with the Reasonably Available Control Technology (RACT) requirements found at 6NYCRR Part 227-2. In accordance with 6NYCRR Parts 621(d)(9) and 201-6.4(c), the Administrator of the U.S. Environmental Protection Agency (US EPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements the Clean Air Act or 6NYCRR Part 201.
