Request for Recreational Reservoir Releases

Background: DEC Part 670 Reservoir Releases Regulations (Schoharie Reservoir - Shandaken Tunnel - Esopus Creek), developed pursuant to Title 8 of Article 15 of the Environmental Conservation law, were implemented in May 1977. The purpose of these regulations is to regulate the volume and rate of the flow of water from the Schoharie Reservoir via the Shandaken Tunnel into the Esopus Creek to protect and enhance the recreational use of the waters in the creek while ensuring an adequate water supply for New York City.

This notice is to advise of a request the NYSDEC has received from the American Whitewater, on behalf of their membership and that of the Kayak and Canoe Club of New York, the Appalachian Mountain Club and the American Canoe Association, for the department to provide diversions for the following annual special recreational events:

June 3-4, 2000: 1000-1100 cfs for KCCNY Slalom
July 15-16, 2000: 1000-1100 cfs for AMC Whitewater Instruction
Sept. 9-10, 2000: 1000-1100 cfs for AMC Instruction
Sept. 30-Oct.1, 2000: 850-1000 cfs for ACA Esopus Slalom

The department is currently evaluating the request. These events are well attended and important to the economy of the area. Current hydrologic and weather conditions allow the department to approve the June 3-4 recreational event. Any approval of the future events will be subject to favorable hydrologic and weather conditions.

Negative Declaration

Orange County - The Town Board, Town of Montgomery, as lead agency has determined that the proposed adoption of local law #1 of 2000, will not have a significant adverse environmental impact. The action involves a variety of text changes and authorizes the Planning Board to cluster subdivisions in all zones in accordance with Section 278 of Town Law. The project is located townwide.

Sullivan County - The Town of Bethel Planning Board, as lead agency has determined that the proposed A Day in the Garden at Yasgur's Farm, will not have a significant adverse environmental impact. The action involves an application of G.F. Entertainment, LLC for special use permit and site plan approval to implement an outdoor recreation activities venue on assembled parcels comprising roughly 400 acres in the Town of Bethel, Sullivan County, New York. The project is located at and around the intersection of Hurd Road and West Shore Road, Town of Bethel, Sullivan County, New York.

Positive Declaration

Putnam County - The Town of Patterson Zoning Board of Appeals, as lead agency has determined that the proposed Patterson Pavilion Shopping Center may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a request for approval of a special use permit, site plan and lot line adjustment of a proposed 519,700 square foot retail center and a 49,000 garden center located in the "I" zoning district, for a total of 77.67 acres. The project is located on three parcels in the Town of Patterson.

Notice of Acceptance of Draft EIS and Public Hearing

Dutchess County - The East Fishkill Town Board, as lead agency has accepted a Draft Environmental Impact Statement on the proposed nine amendments of the Town of East Fishkill Zoning Laws. A public hearing on the Draft EIS will be held on June 8, 2000 at 7:30 p.m. at the Town Hall, 330 Rt 376, Hopewell Junction New York. Written comments on the Draft EIS will be accepted by the contact person until Thursday, June 22, 2000 at 4:00 p.m. The action involves amendments to the following laws: Local Law "B", a local law amending the zoning definitions and provisions on "farming", and creating the ‘Active Farm Overlay (AFO)' zone; Local Law "C", a local law placing certain residentially zoned properties in the ‘Active Farm Overlay (AFO)' zone; Local Law "D", a local law amending the zoning provisions applicable to the Conservation Residential Development (CRD) zone; Local Law "E", a local law changing the zoning classification of approximately 221.5 acres of land in the vicinity of Seaman Road from light industrial (l-1S) to residential (R-2); Local Law "F", a local law changing the zoning classification of approximately 55 acres of land in the vicinity of Jackson road from Industrial (l-1) to Residential (R-1); Local Law "G", a local law changing the zoning classification of approximately 15 acres of land in the vicinity of Ryan Drive from Heavy Industrial to Residential; Local Law "H", a local law changing the zoning classification of approximately 158.55 acres of land from Heavy Industrial to Conservation Residential and approximately 10.85 acres of land from residential to conservation residential; Local Law "I", a local law changing the zoning classification of approximately 26 acres of land located in the vicinity of the Hamlet of Hopewell Junction of Heavy Industry to Residential; and Local Law "J" a local law eliminating excavation and filling as a permitted principal use in residential zoning districts. The project is located in the Town of East Fishkill, New York.

Orange County - The Town of Montgomery Planning Board, as lead agency has accepted a Draft Environmental Impact Statement on the proposed Greenwalt Development-Warehouse and Distribution Center. A public hearing on the Draft EIS will be held on Monday, June 12, 2000 at 7:45 p.m. at the Town Hall. The action involves construction of a 489,000 square foot warehouse and distribution center plus a 15,000 square foot internal office plus a 257,000 square foot expansion of the distribution facility, plus parking area for 291 truck trailers and 177 automobiles. The project is located on County Road 99 adjacent to I-84 to the north and Consolidated Railroad line to the east.

Ulster County - The Town Board of the Town of Shandaken, as lead agency has accepted a Draft Environmental Impact Statement on the proposed Wastewater Project. A public hearing on the Draft EIS will be held on June 14, 2000 at 7:00 p.m. at Phoenicia Elementary School, Route 214, Phoenicia, New York. Written comments on the Draft EIS will be accepted until July 5, 2000. The action involves the construction of a wastewater treatment plant together with associated sewer system and the acquisition of real property rights to implement the construction. The project is located in the Hamlet of Phoenicia, Town of Shandaken, New York.
