Project Description:
 The applicant proposes to construct a new facility that will include: an office building, septic system, parking lot, maintenance building, fuel bay, wash bay with a closed-loop system that will recycle wash water and a heavy equipment storage area. The facility will impact approximately 12.88 acres of freshwater wetland WN-1, and about 2.35 acres of Federal regulated wetland. To mitigate for wetland impacts, Otis Eastern Service, Inc. will create approximately 4 acres of wetland, 1 acre to the east of the proposed facility and 3 acres within a 33.61 acre site currently owned by Otis Eastern Service, Inc., southwest of the proposal, next to a parcel known as "Brown's Marsh," owned by the Western New York Land Conservancy, Inc. (WNYLC) and also part of WN-1 wetland. The mitigation plan also includes transfer of ownership of the 33.61 acre parcel and a 3.25 acre strip between the proposed facility and Brown's Marsh. The applicant is also proposing to transfer ownership of an 84.39 acre parcel to the WNYLC. The 84.39 parcel is located to the south of the proposed facility

Project Description:
 The Department has made a tentative determination to approve and has prepared a draft Title V facility permit, which includes a 49 tons per year (tpy) CAP on VOC emissions, for Unicell Body Company, Inc. Unicell operates a fiberglass truck body manufacturing and installation facility on Howard Street, in Buffalo, New York. This facility also installs and paints steel truck bodies made by other manufacturers. Emission Unit A-MOLD contains all the molding and assembly operations involved in manufacturing the fiberglass van bodies, which includes the airless spray and manual application of resin and gelcoat to open molds. Emission Unit B-PAINT consists of the undercoating of all truck bodies and the spray painting of a portion of the steel truck bodies. Unicell also operates seventeen natural gas fired heating units which are exempt from permitting under 6NYCRR201-3.2. Styrene emissions from the fiberglass molding processes exceed the 10 ton per year (tpy) title V applicability threshold for individual hazardous air pollutants (HAPs). A proposed MACT Standard for Reinforced Plastic Composites Manufacturing is expected in July 2000, which Unicell will be required to comply with, once promulgated. In addition, the facility-wide potential to emit (PTE) volatile organic compounds (VOCs) exceeds the 50 tons per year threshold for both 6NYCRR Subpart 212.10, Reasonably available control technology for major facilities and 6NYCRR Subpart 228.8, Table 2 for surface coating processes. To avoid the requirements of these regulations, Unicell has chosen to CAP VOC emissions and limit their PTE for VOCs to 49 tpy. The draft permit is available for review at the Department's Region 9 office in Buffalo, New York. In accordance with 6 NYCRR Parts 621.5(d)(9) and 201-6.4(c) the Adminis- trator of the United States Environmental Protecton Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

Project Description:
 The Department has drafted a permit pursuant to Article 19, Air Pollution Control, of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments for the existing facility-wide emissions of the CH Resources electrical power generation facility located at 5300 Frontier Avenue. The facility consists of a 468,000 lb/hr circulating fluidized bed (CFB) coal-fired boiler, a 51,000 kw turbine generator and a baghouse to remove particulates prior to discharge from the stack. The permit is permitted primarily under the following regulations: 6NYCRR Part 201-6 (requires facility to obtain a Title V permit), 40CFR 52 Subpart A, Prevention of Significant Deterioration - PSD, (regulates emissions from the CFB); and 40CFR 60 Subpart Dc regulates emissions from the auxiliary boiler. The firm is under Order on Consent to install selective non-catalytic reduction equipment to control oxides of nitrogen during ozone season (May - September). Equipment will be installed prior to issuance of the permit. In accordance with 6NYCRR Part 621.5(d)(9) & 210-6.4(c), the Administrator of the United States Environmental Protection Agency has the authority to bar issuance of any Title V facility permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:
 The Department has reviewed the hazardous waste management permit application and has made a tentative determination to issue a permit to Akzo Nobel Chemicals Inc. (AKZO) Burt Facility, 2153 Lockport-Olcott Rd. AKZO manufactures a variety of organic peroxide initiators in various physical forms and several types of solid anti-static agent additives used in the plastics industry. The hazardous wastes generated at the plant are due to off-specification or contaminated products and/or residue resulting from the clean up of spills of raw materials or products stored at the facility. Since organic peroxides and some raw materials possess ignitable and reactive characteristics, the hazardous wastes generated at the facility as a consequence will show the same ignitable and reactive characteristics. The facility also generates solvent waste in their laboratory. AKZO operates four hazardous waste management units, which will be al authorized for renewal under the proposed permit. In addition, AKZO operates a wastewater pretreatment system that is exempt from the permitting process. The treated wastewater is discharged to the Town of Newfane Wastewater Treatment Plant. Hazardous Waste Container Storage Pad, Area 1 is a 40 ft. by 56 ft. by 6 inch thick concrete pad surrounded by a 4 inch high concrete curb. Located on this pad is an 8 ft. by 14 ft. by 6 ft. aluminum shed on 6 inch supports (an old box trailer placed on 6 inch steel I-beams). The shed has a capacity of 196, 5-gallon plastic pails and the pad has a capacity of 208, 55-gallon drums. The total containment volume of the diked area is 5,529 gallons. Hazardous Waste Container Storage pad, Area 2 is a 32 ft. by 32 ft. by 6" thick concrete pad surrounded by a 3 inch high concrete curb. This pad has a capacity of 52, 55-gallon drums and has a containment volume of 957 gallons. Tank #2041A (3rd hazardous waste management unit) is used to receive off-specification organic peroxides and destroy them by caustic destruction. The tank has a design capacity of 1,907 gallons and an operating capacity of 1,410 gallons. This tank is located inside a concrete containment area having a capacity of 2,400 gallons. Tank #2041B (4th hazardous waste management unit) is used to receive and store organic peroxides that have gone through caustic destruction and then neutralization. The tank has a design capacity of 2,156 gallons and an operating capacity of 1,410 gallons. This tank is located inside a concrete containment area having a capacity of 2,400 gallons. The NYSDEC Draft Permit specifies that AKZO must sample and evaluate several solid waste management units (SWMUs) to determine if corrective measures are needed. The application and draft permit are available at the region 9 Buffalo office for review.
