In order to meet developmental restriction specified in 6NYCRR Part 661.6(4), the applicant proposes to create 8076 square feet of deed restricted Tidal Wetlands Adjacent Area. The applicant proposes to construct 5 new one-family houses and construct additions to 2 existing houses. Approximately 10 - 20 feet of three of the lots proposed for new houses are within 100 feet of NYSDEC regulated Freshwater Wetland AR-13 (Blue Heron Park South). No houses will be constructed or expanded within the regulated adjacent area. The only proposed activity within the adjacent area is curb construction and utility connections. The wetland is on the opposite side of Lipsett Ave. from the project site. The project site is bounded by Lipsett Avenue, 4th Court, Boardwalk & Ocean View Avenues, Staten Island, Block 6393.

Project Description:
The applicant proposes to demolish an existing house and construct 6 2-story, 2-family townhouses. Approximately half of the proposed townhouses are within the adjacent area of NYSDEC regulated Freshwater Wetland AR-10 (Lemon Creek). The mapped wetland area adjacent to the project site is an open culvert which was reconstructed in 1994 by NYC Dept. of Environmental Pertection under DEC Permit 2-6405-00138/00001. To reduce impacts, a deed restricted planted buffer will be established between the development and the wetland. The project is located on Depew Place, a private road accessed from Maguire Avenue, Block 6944, Lot 78.
