Project Description:
 The VanDeMark Group, located in Lockport, N.Y., has submitted an application for and this Department has made an initial determination to approve a modification to the company's Title V permit to produce a new product in existing equipment using existing control devices. Production will result in potential emissions of sulfur dioxide greater than the 40 ton deminimus and therefore is subject to a Prevention of Significant Deterioration Applicability (PSD) review. By accepting federally enforce- able conditions establishing the efficiency of the control equipment at 91%, the facility will limit its potential emissions of SO2 to less than the significant emission threshold of 40 tons and therefore, will not be subject to the requirements of 40 CFR Part 52 Prevention of Significant Deterioration. In accordance with 6 NYCRR Parts 621.5(d)(9) and 201-6.4(c) the Adminis- trator of the United States Environmental Protecton Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

Project Description:
 The Department has made a tentative determination to approve an application for a Title V Permit, required by Title V of the Federal Clean Air Act Amendments and Article 19, Air Pollution Control, of the Environmental Conservation Law (ECL), and has prepared a draft permit for Morton Salt Division. The facility, located at 45 Ribaud Avenue East, produces, packages, & ships evaporated sodium chloride (NaCl) salt products. This proposed permit contains NOx Reasonably Available Control Technology (RACT) emission limits, particulate emission limits & monitoring requirements for the coal fired boiler. The coal is subject to sulfur content limits. The permit authorizes the facility, under certain limitations, to burn waste oil, generated on site in its coal fired boiler. The permit also limits the hours of operation of the natural gas fired auxiliary boiler to 500 hrs/year. By limiting NOx emission from the boiler, it is not subject to RACT requirements. A RACT variance was previously submitted & has been forwarded to the United States Environmental Protection Agency (EPA) for approval. The permit contains particulate emission limits & monitoring requirements for various scrubbers & baghouses used to control dust generated by material handling & transport. The application & Draft Permit are available for review at NYSDEC Reg. 9 Office. In accordance with 6NYCRR Part621.5(d)(9) & 201-6.4(c), the Administrator of the EPA has the authority to bar issuance of any Title V Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
