Public Notice

Niagara County - The Department of Environmental Conservation has determined that the Registry of Inactive Hazardous Waste Disposal Sites in New York State needs to be amended to delete site number 932071, known as the Diamond Shamrock Site. This site is located in the City of Lockport in the County of Niagara and is located at 500 Ohio Street. The reason for deletion is: Investigations conducted at this site confirmed the presence of limited amounts of coal, ash and sodium silicate resulting from previous industrial activities at this location. These wastes, however, were not found to be hazardous as defined by 6NYCRR Part 371. Thus, the site should not be included in the Registry of Inactive Hazardous Waste Disposal Sites in New York State as there has been no documented disposal of hazardous waste at this site.

Positive Declaration and Public Scoping

Niagara County - The New York State Department of Environmental Conservation, as lead agency has determined that the proposed Modern Landfill, Inc. Proposed Expansion may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until 6/7/00. A public scoping session will be held on 5/24/00 at 6:30 p.m. at Lewiston Fire Company No. 1, 145 North Street, Lewiston NY 14092. The action would increase the total permitted landfill footprint from approximately 117 acres to a maximum of 239 acres. The proposed action would also increase the maximum permitted height of the landfill by 60 feet, from 416 feet above sea level using the National Geodetic Vertical Datum established in 1929 (416 NGVD 29) to 476 feet NGVD 29. The maximum annual tonnage of waste accepted would also increase from 577,976 to 615,000 tons per year. The landfill life would be extended from ten years to 40 years. As part of the action, an existing Town of Lewiston Landfill would be excavated and disposed of by incorporating Town landfill waste into the existing Modern landfill disposal area. The former Town Landfill area would then be used as part of the proposed Modern landfill expansion project. The project is located at the intersection of Pletcher and Castle Garden Roads in the Town of Lewiston, Niagara County on a 380 acre land parcel owned by Modern Landfill Inc., part of which is already being operated as a landfill.

Positive Declaration and Notice of Acceptance of Draft EIS

Chautauqua County - The State Education Department, as lead agency, has required and accepted a Draft EIS on the proposed land acquisition and construction of a New Bus Garage in the Ripley Central School District, SED Project No. 06-24-01-04-5-009-001. Comments are requested on the Draft EIS and will be accepted by the contact person until May 19,2000. The action involves the purchase of 4 acres of land adjacent to existing property and 5,500 square feet of new construction. The project is located on Ross Street in the Town of Ripley.

Chautauqua County - The State Education Department, as lead agency, has required and accepted a Draft EIS on the proposed land acquisition and additions/alterations to the Main School Building in the Ripley Central School District, SED Project No. 06-24-01-04-0-001-008. Comments are requested on the Draft EIS and will be accepted by the contact person until May 19, 2000. The action involves the purchase of an adjacent 80 foot by 18 foot parcel of land and 30,000 square feet of new additions. The project is located at 12 North State Street in the Town of Ripley.

Notice of Acceptance of Final EIS

Niagara County - The Town of Porter Town Board, as lead agency has accepted a Final Environmental Impact Statement on the proposed CWM Chemical Services, LLC, Re-zoning and Local Ordinance Amendment. The action involves the re-zoning of approximately 150 acres of property in the town of Porter, County of Niagara, State of New York. The current zoning pursuant to local ordinance is M-2 General Industrial and the proposed re-zoning classification is M-3 Heavy Industrial. The action also proposes to amend Section 473.3 and 473.10 of the Town of Porter Zoning law to reduce setbacks and increase height restrictions related to the construction of facilities within the zoned areas. The project is located CWM Chemical Services, LLC, Model City Facility, 1550 Balmer Road, Town of Porter, County of Niagara, New York.
