Project Description:
The applicant proposes to add a wash plant with a closed-loop (recycling) wash water circulation system, a conveyor to transport mined material from the applicant's adjacent (to the north) Emerson Sand & Gravel Mine in the Town of Almond (DEC #9-0226-00021/00005) for processing, the installation of a water supply pipeline to serve the plant, from the applicant's Alfred Station Sand & Gravel Plant (DEC #9- 0220-00007/00001) and relocation of internal haul roads. The reclamation plan includes changes in final contours and leaving large natural cemented gravel formations exposed by mining, in place. No change in the reclamation objective (meadow for pasture and/or reforestation) has been proposed. The conveyor corridor will be on the applicant's property and will add about 1.8 acres. The pipeline will not add to the mine acreage. The applicant's Alfred Sand & Gravel Mine is the former Alfred Atlas Mine located north of NYS Route 244 in the hamlet of Alfred Station.

Project Description:
The Department has made tentative determinations to approve these applications for a Title IV Acid Rain Permit, required by 40 CFR Part 72, and Air Title V Facility Permit, required by Title V of the Federal Clean Air Act Amendments and Article 19 (Air Pollution Control) of the Environmental Conservation Law (ECL), and has prepared draft permits for the Rochester Gas & Electric Corp's Allegany Station #133 which is an existing 60 MW gas turbine, electric generation plant, located at 11537 Route 19A, in the Town of Hume, Allegany County, New York. The RG&E Allegany Station #133 (formerly known as the Kamine Allegany Cogeneration Facility) lost its designation as a cogeneration facility when it lost its steam host, a greenhouse, so it is now subject to Title IV (40 CFR 72) and Title V (NYCRR 201-6) permitting. Issuance of the Title IV, Acid Rain Phase 2 permit, will require the facility to record SO2 and NOx emissions, and obtain SO2 allocations for the SO2 emitted annually. Title V permit will require the facility to comply with the "NOx Emissions Budget and Allowance Program" of 6NYCRR 227-3. New Source Performance Standards (NSPS), 40 CFR 60, apply to the gas turbine and the associated duct burner. The hourly NOx and CO emissions are limited, to avoid applicability to Prevention of Significant Deterioration (PSD) 40 CFR 52.21, requirements and annual NOx emissions for the facility are limited to 99 tons per year. In accordance with 6NYCRR 621 and 201 the Administrator of the USEPA has the authority to bar issuance of any Title IV or V permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR 201.

Project Description:
The applicant proposes a 4.1 acre addition to the previously permitted 140 acre "Borer Deposit" sand and gravel mine, for the purpose of a permanent spoil area for sediments from the existing processing plant sediment basin. This is intended to provide for sediment disposal until sufficient area of the approved mine has been excavated to allow disposal along the east mine face in accordance with the permitted plan. The new spoil area will be reclaimed to a sloping meadow that will be allowed to grow into volunteer shrubs and trees. The Borer Deposit mine is located north of NYS Rte 98, south and east of the hamlet of Sandusky. The mine addition is north of the existing mine settling basin, on the applicant's land.

Project Description:
The applicant proposes improvements (change of grade, road realignment/reconstruction, etc.) to a five-legged intersection consisting of County Road 99 (Peck-Settlement Road), County Road 341 (Martin Road) and Manchester Road. Realignment of Martin Road will occur within a portion of State Regulated Freshwater Wetland No. JA-9. Approximately 117 sq. ft. of the JA-9 wetland and 199 sq. ft. of adjacent area will be impacted. To mitigate project wetland impacts, the applicant will create approximately 714 sq. ft. of wetland next to the realigned road, adjacent and to the north of the wetland JA-9. The proposal is located at the intersection noted above, approximately 6,000 feet southeast of the City of Jamestown.

Project Description:
The Department has made a tentative determination to approve this application for a modification of an existing permit (NY-0003077) which authorized increasing the existing discharge at Outfall 001 of 130,000 gallons per day to 450,000 gallons per day maximum of quarry stormwater from the permittee's settling pond into the Erie Barge Canal. The request is being made due to the greater quarry stormwater and groundwater flows currently being encountered. These flows are being generated by the increasingly larger quarry size and a groundwater spring which was encountered in the south quarry. Pumping of the quarry sump water will be done in the night time operation only. Outfalls 002 and 003 remain unaffected by this modification. The quarry is located on Hinman road east of Route 270 and west of the Erie Barge Canal. A draft permit is available for inspection at the NYS DEC Region 9 Office.
