Project Description:
The Department has prepared a draft permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act amendments and made a tentative determination to approve this application for the applicant's Warex Terminal Corporation - North Terminal located in the Town of New Windsor, Orange County, New York. It is a privately owned bulk fuel and distribution terminal consisting of six above ground storage tanks with internal floating roofs, four above ground storage tanks with fixed roofs, one vapor combustion unit and an oil water separator. The storage tanks contain gasoline, gasoline additives and heating/diesel oil. The truck loading rack has the vapors captured and controlled by the vapor combustion unit. The SIC code is 5171 - Petroleum Bulk Stations and Terminals. This facility has the Emission Potential which exceeds the Title V thresholds for Volatile Organic Compounds (VOC) and Hazardous Air Pollutants (HAP). The facility falls under various state and federal regulations including 6NYCRR Parts 201 and 229, and 40CFR 63.420 Subpart R. For compliance, Warex has imposed a through put cap of 190,000,000 gallons of gasoline per year, with a 12 month rolling average. In accordance with 6NYCRR parts 621.5(d)(9) and 201-6.4(c), the Administration of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. The Application and Draft Permit are available for review at the Region 3 Office of the New York State Department of Environmental Conservation.

Project Description:
The applicant requests the following permits in conjunction with a 100 lot residential subdivision on a 2466 acre property located in the Swamp Pond/Neweiden section of the Town of Tusten: - FRESHWATER WETLANDS to construct a short segment (approximately 50 linear feet) of new roadway within the 100 foot adjacent area of Freshwater Wetland EL-11 (Class II). - PROTECTION OF WATERS for various maintenance activities on the Swamp Pond (Weiden Lake) dam and for the construction of two road crossings of unnamed tributaries of Swamp Pond/East Branch Tenmile River. - MINED LAND RECLAMATION to excavate approximately 15,000 cubic yards of sand and gravel from 2.5 acres for use in the construction of the subdivision roadway. The applicant has also prepared a storm water management plan and erosion control plan for the overall subdivision in order to gain coverage under the Department's General SPDES permit for construction sites.
