Project Description:
 A total of 46.01 acres of additions to the existing 77.7 acre Portville Sand & Gravel Mine located east of NYS Route 305 and north and south of Barbertown Road are proposed. The additions consist of 27.09 acres of the "Rhinehart West" parcel located 300 ft north of Barbertown Rd and west of the Conrail Right-of-way; 10.07 acres of the "Rhinehart East" parcel located about 300 ft north of Barbertown Rd and east of Conrail; 6.79 acres of the "Linn et.al." parcel located east of Conrail between Rhinehart East and Barbertown Rd (47.8 acres are currently permitted) and the 2.06 acre "Isthmus" on the applicant's land south of Barbertown Rd and east of Conrail. Mining will enlarge an existing pond to a 21.2 acre lake on the Rhinehart West; enlarge the existing 26.3 acre lake on the Linn et.al. to continue onto the Rhinehart East, creating a 44.57 acre lake and will connect two lakes currently separated by the Isthmus into a single 21.26 acre lake. The loss of 1.19 acres of Federally regulated wetland will be mitigated by 2.05 acres of wetlands along the shorline of Rhinehart East and constructing a 8.03 acre floodplain wetland. Mined material will be trucked to the existing mine plant area at the corner of Barbertown Rd and Route 305 for processing.

Project Description:
 The Department has prepared a "draft" State Facility Permit which contains a variance for coating operations at the Niagara Transformer Co.. Niagara Tranformer custom manufactures high voltage electrical transformers. Operations such as varnishing and the coating of housings are subject to Reasonable Available Control Technology (RACT) regulations contained in 6NYCRR Part 228. Facility actual emissions of VOC are approximately 10 tons per year (tpy). The applicability threshold in part 228.7 is 10 tpy. A RACT analysis was submitted which documented the lack of acceptable compliance coatings and control equipment costs above "RACT". The permit establishes conditions for maintaining the variance.

 The applicant is proposing to transport and dispose of septage by land application on a 17 acre field owned by Sylvia Mahar located at 8505 Chapman Road, approximately 2000 feet east of Hartland Road in the Town of Hartland, Niagara County. Land application activity will be restricted to the months of June, July, August and September each year. The septage will be landspread and incorporated into the soil within 24 hours of application.

Project Description:
 The applicant is proposing maintenance, for agricultural purposes, of approximately 2200 feet of Trout Brook, which has a Class and Standard of C(T). The project will involve grading and shaping eroded banks and the removal of gravel deposits to create a "V" shaped centerline in the stream channel. The project is located approximately 1500 feet east of Sheppard Road, just north of the railroad tracks.
