Project Description:
 The Department proposes to modify the existing State Facility Air Permit for Keeler Construction's stone crushing plant and hot mix asphalt plant operation at their Barre Stone Products facility located at14120 West Lee Road in the town of Barre, Orleans County. The current permit has a federally enforceable facility limit of 194,818 pounds per year of Oxides of Nitrogen (NOx) which results in the overall limiting of the 5 criteria pollutants to below the threshold of Title V of the Clean Air Act. The proposed modification will raise the facility limit of NOx to 199,800 pounds per year which is still below the threshold of Title V. The new limit will allow the installation of a new portable crushing & screening plant, identified as new Emission Unit 5-HP300, and add a new diesel fueled, 947 horsepower genset to existing Emission Unit 4-GENST. The limit of hot mix asphalt production for the facility will remain at 230,000 tons per year based on a 12 month rolling average. The proposed permit will contain specific fuel use limits for each individual genset and the applicant has agreed to maintain records that verify facility emissions of NOxduring any consecutive 12 month period. All required records must be maintained on site fo a minimum of 5 years and made available to the Department upon request to verify compliance with permit conditions. The application and draft permit are available for review at the Region 8 office located at 6274 East Avon - Lima Rd., Avon.

Project Description:
 The Department has received an application for a Title V Facility Permit for existing processes at the Hampshire Chemical Corp - Evans Chemetics facility, located at 228 E Main St in the Village of Waterloo, Seneca County. The facility emits air contaminants from the synthesis of organic sulfur intermediates used in the cosmetic, pharmaceutical, and plastic industries, and from four process and heating steam boilers. It meets the definition of a major stationary source, and is required to obtain a Title V Permit as specified in 6 NYCRR Part 201-6, due to potential emissions in excess of Title V thresholds specified in 6 NYCRR Part 201-2 and Title V of the Clean Air Act for a Major Stationary Source: 100 tons per year of sulfur dioxide (SO2); 10 tons per year of a single hazardous air pollutant (HAP); and 25 tons per year of total HAP. This facility previously agreed to restrict volatile organic compound (VOC)emissions to below the Part 212.10 VOC RACT threshold of 50 tons per year, and oxide of nitrogen (NOX)emissions to below the Part 227-2 NOX RACT threshold of 100 tons per year. The application and the Draft Title V Permit are available for review at the Region 8 NYSDEC office. If comments raise significant issues, the Department may modify the Draft Permit. Pursuant to 6NYCRR Parts 621.5(d)(9) and 201-6.4(c)(1), the Administrator of EPA has the authority to bar issuance of any Title V Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. After the comment period, EPA will have 45 days to review the Proposed Title V Permit, which is the Draft Permit with any modifications. The Department may issue the Proposed Permit as a Title V Facility Permit if EPA has raised no objection.

Project Description:
 The Department has made a tentative determination to issue an initial Title V Facility Air Permit to Pactiv Corporation for their facility located at 200 East Main St. in the village of Macedon, Wayne County. The company produces plastic packaging products using extrusion, film treatment, printing and material handling operations. The applicant proposes to limit or "cap" the facility's emissions of Hazardous Air Pollutants (HAPs), both individual and total,to 19,999 and 49,999 pounds per year respectively, which is below the threshold for applicability of the printing and Publishing NESHAP, 40 CFR 63 Subpart KK.The applicant has agreed to maintain records that verify facility emissions of individual and total HAPs during any consecutive 12 month period. All required records must be maintained on site for a minimum of 5 years and made available to the Department upon request to verify compliance with permit conditions. The application and draft permit are available for review at the Region 8 Avon office. Comments must be received within the 30 day period ending on the last filing date indicated. The Department may modify the draft permit based on significant or important information raised during the comment period. In addition, the Administrator of the US EPA has the authority to bar issuance of any Title V permit determined not to be in compliance with the Clean Air Act or 6 NYCRR Part 201. Following the 30 day comment period, the US EPA will have an additional 45 days to review the draft or modified draft permit. If the US EPA does not raise any objection in that time, the Department may issue the final draft permit as the Title V permit.
