Negative Declaration

Schenectady County - The City of Schenectady City Council,, as lead agency has determined that the proposed MVP Health Plan Office Building will not have a significant adverse environmental impact. The action involves the development of a vacant 2.2 acre site to construct an eight story, 225,000 square foot office facility with an attached multi-level parking garage to accommodate 1,000 vehicles. The action also involves the rezoning of the subject site from "F" Business to "OCBD" Office Central Business District and zoning text modifications regarding plaza space requirements. The project is located at the northwest corner of the intersection of State Street & Nott Terrace in the City of Schectady.

Notice of Acceptance of Draft EIS

Otsego County - The State Education Department, as lead agency, has required and accepted a Draft EIS on the proposed construction of a new bus garage in the Schenevus Central School District, SED Project No. 47-09-01-04-5-007-001. Comments are requested on the Draft EIS and will be accepted by the contact person until February 23, 2000. The action involves 18,000 square feet of new construction. The project is located at 100 Main Street in the Town of Schenevus.

Otsego County - The State Education Department, as lead agency, has accepted a Draft EIS on the proposed land acquisition and construction of a New Bus Garage for the Oneonta City School District, SED Project No. 47-14-00-01-5-019-001. Comments are requested on the Draft EIS and will be accepted by the contact person until March 3, 2000. The action involves the purchase of 3 acres of land and 13,500 square feet of new construction. The project is located on Silas Lane in the Town of Oneonta.

Schenectady County - The State Education Department, as lead agency, has accepted a Draft EIS on the proposed addition and alteration to the Jefferson Elementary School in the Schalmont Central School District, SED Project No. 53-05-01-06-0-005-010. Comments are requested on the Draft EIS and will be accepted by the contact person until March 3, 2000. The action involves the addition of 25,500 square feet of construction. The project is located at 100 Princetown Road in the Town of Rotterdam.

Notice of Acceptance of Draft EIS and Public Hearing

Rensselaer County - The Rensselaer County Industrial Development Agency, as lead agency has accepted a draft Environmental Impact Statement on the proposed Patriot's Landing Project. A public hearing on the draft EIS will be held on February 22, 2000 in the Second Floor Conference Room at City Hall, Rensselaer . Written comments on the draft EIS will be accepted until February 22, 2000. The action involves the proposed construction of a 14 story, 286 unit apartment building with attached underground basement parking area , private and public recreation facilities and a river front walkway. The project is located at 4-6-8-10-12 Riverfront in the City of Rensselaer.

Notice of Acceptance of Supplemental Draft EIS And Public Hearing

Columbia County - The New York State Department of Environmental Conservation, as lead agency has accepted a Draft Supplemental Environmental Impact Statement on the proposed modification of the B-3 Limited Partnership existing Solid Waste Management permit for the EAC B-3 Transfer Station. The applicant proposes to expand the capacity of the existing transfer station from an annual average daily throughput of 350 tons per day (current permitted limit) to 520 tons per day.

The existing transfer station located at Flint's Crossing Road in the Town of Canaan currently is permitted to accept up to 300 tons per day of municipal solid waste (MSW) and up to 50 tons per day of construction and demolition debris & D). The applicant is seeking approval to increase the permitted amount of waste from 300 to 345 tons per day of MSW and from 50 to 175 tons per day of C & D.

The transfer station will continue to support recycling in its service area and will not accept or handle source separated recycled materials waste from the MSW stream. The existing structures at the facility do not need to be expanded in order to accommodate the proposed increase in the throughput, nor do any new structures need to be constructed.

Project Location: The B-3 Limited Partnership transfer station is located at Flint's Crossing Road, east of NYS Route 22 and north of Exit B-3 of the New York State Thruway (Berkshire Spur), in the Town of Canaan, Columbia County.

NYS Environmental Conservation Law: The subject Solid Waste Management permit application is being processed by the NYS Department of Environmental Conservation (NYSDEC) pursuant to Environmental Conservation Law (ECL) Article 3, Title 3 (General Functions), ECL Article 27, Title 7, (6 NYCRR Part 360-Solid Waste Management) and 6 NYCRR Parts 621 (Uniform Procedures) and 624 (Permit Hearing Procedures).

SEQRA Status: The NYSDEC has determined that the proposal is an Unlisted action pursuant to 6 NYCRR 617. A SEQR Positive Declaration was issued by the Department as lead agency on July 26, 1999, requiring the preparation of a Supplemental Draft Environmental Impact Statement (Supplemental DEIS).

Legislative Public Hearing: A Legislative Public Hearing to receive unsworn statements from the public on the application and the Supplemental Draft Environmental Impact Statement will be held on March 20, 2000, beginning at 7: 00 P.M. at the Town of Canaan Town Hall located on Columbia County Route 5, Canaan, NY. All persons, organizations, corporations, or government agencies which may be affected by the proposed project are invited to attend the hearing and to submit oral or written comments. It is not necessary to file in advance to speak at the legislative hearing. Lengthy statements should be in writing and summarized for oral presentation. If necessary, reasonable time limits may be set for each speaker to afford everyone an opportunity to be heard. Equal weight will be given to both oral and written statements. The hearing location is fully accessible to persons with a mobility impairment.

Written Comments: All comments must be filed with the NYSDEC Division of Environmental Permits, 1130 North Westcott Road, Schenectady, NY 12306, Attention: Michael Higgins, Project Manager. Written comments should be substantive in nature and must be submitted by no later than COB on March 17, 2000.

NOTE: The Department reserves the right to cancel the Legislative Public Hearing scheduled for March 20, 2000, if no substantive written comments are received by COB on March 17, 2000.
