Operable Unit 1 (Parcel F) and Operable Unit 2 (Parcels C, H and I)

The New York State Department of Environmental Conservation (NYSDEC) announces that the printed Record of Decisions (RODs) for the Yonkers Downtown Waterfront Environmental Restoration Site, Phase 1, Operable Units 1 & 2, located in the City of Yonkers, Westchester County are available. The RODs present the selected remedies for these operable units and the rationale for the chosen remedies.

Public meetings for these RODs were held on October 6, 1998 (Operable Unit 1) and on August 4, 1999 (Operable Unit 2), presenting the Proposed Remedial Action Plans (PRAPs) for these operable units. The comments received at these meetings and in writing during the public comment periods were considered. The RODs contain a Responsiveness Summary addressing these public comments. The chosen remedial action plans described in the Operable Unit 1 and Operable Unit 2 RODs are summarized as follows:

Negative Declarations

Orange County - The Town of Goshen Town Board, as lead agency has determined that the proposed Introductory Local Law - Solid Waste and Recyclables Collection and Disposal Law will not have a significant adverse environmental impact. The action involves the adoption of a local law to permit and regulate recyclables handling and recovery facilities. The law also regulates and controls associated hauling operators and addresses anti-competitive effects in the carting industry. The project is located in the Town of Goshen.

Rockland County - The Village of Montebello Village Board, as lead agency has determined that the proposed Zoning Amendment to allow Continued Care Retirement Communities in the PO zoning district and Assisted Living Residences in the LO-C zoning district will not have a significant adverse environmental impact. The action involves the adoption of zoning amendments to allow senior housing in the PO and LO-C zoning districts upon special approval of the Montebello Planning Board. The project is located in the Village of Montebello.

Positive Declaration

Draft Supplemental EIS & Notice of Public Scoping

Dutchess County - The Town of East Fishkill Planning Board, as lead agency has determined that the proposed Unity Plaza Site Plan Amendment may have a significant adverse impact on the environment and a Draft Supplemental Environmental Impact Statement must be prepared. A public scoping session will be held on February 1, 2000 at 7:30 PM at the Town of East Fiskill Town Hall, 330 Route 376, Hopewell Junction. Written comments on the draft scope will be accepted until 4:00 PM on February 22, 2000.

The action involves the application for final site plan approval on an 11.49 acre parcel for a commercial development with associated parking and drainage. The original findings were approved on July 1, 1992 and revised on December 3, 1996. The plan amendment now before the Town involves changes to the project that were not previously the subject of the EIS and Findings. 1. The revised plan proposes an on-site treatment facility that requires surface discharge into the Whortlekill, and 2. Current stormwater SPDES regulations require water quality treatment be provided during and after construction. The project is located on the north side of NY Route 82 in the Hamlet of Hopewell Junction, East Fishkill.

Notice of Acceptance of a Draft EIS & Public Hearing

Westchester County - The Town of Greenburgh Town Board , as lead agency has determined that the proposed Site Plan Approval for Springhill Suites Hotel Facility may have a significant adverse impact on the environment and a draft Environmental Impact Statement must be prepared. A public hearing will be held on February 23, 2000 at the Town of Greenburgh Town Hall, 320 Tarrytowm Road. Written comments on the Draft EIS will be accepted until 10 days after the close of the hearing.

The action involves the proposed construction of a 145 room short to moderate stay suites hotel together with 145 parking spaces and associated infrastructure on a currently vacant 7.62 acre site. The plan proposes locating 69 of the 145 parking spaces below grade. Site disturbance is estimated to be 2.13 acres. The project is located on the south side of Route 119 at the Town of Greenburgh/Tarrytown municipal line in the Town of Greenburgh.
