Project Description:
The applicant proposes a two lot residential subdivision within the 100-foot adjacent area of DEC regulated Freshwater Wetland NA-2 (Class II). Two single family homes, each with a driveway and small lawn area, will be constructed within approximately 10,000 square feet (0.23 acre) of the 100-foot adjacent area. Both homes will be served by community water and sewer. Portions of the 100-foot adjacent area will be planted with a variety of native trees and shrubs to establish a permanent undisturbed wetland buffer of at least 50 feet.

Project Description:
The Department has made a tentative determination to deny this application for permits for a proposed continuous discharge of a maximum of 37,800 gallons per day of aluminum sulfate (alum) at the Muscoot Dam on the New Croton Reservoir (Class A) in the Town of Somers and the Town of Bedford, Westchester County as part of a two-year pilot study to assess the effectiveness of the alum treatment in reducing organic carbon levels within the reservoir. The applicant predicts that this alum discharge will result in a settleable solids deposit (alum floc) of up to 9.3 inches per year in a maximum area of approximately 326 acres within the reservoir (14.2 % of surface area). The NYCDEP, as lead agency, issued a negative declaration for this Type I action, which was noticed in the October 27, 1999 edition of the Environmental Notice Bulletin (ENB). Notwithstanding NYCDEP's SEQRA determination that the proposed project will not have a significant effect on the environment, DEC has determined that the proposed discharge of alum will violate the narrative water quality standard for settleable solids 6 NYCRR 703.2) and result in the deposition of an environmentally harmful quantity of accumulated particulate on the reservoir bottom, over time.
