Project Description:
The Department has made a tentative determination to approve this application for a modification to a permit for an existing discharge of 0.07 MGD of treated sanitary wastewater into Separator Brook, a Class D stream, from a secondary treatment plant known as the Lyon Mountain Sewer District WWTP located off Sunset Road in the Hamlet of Lyon Mountain. At the applicant's request, the permit limit for total phosphorous will be changed from the Department's policy-based limit of 0.5 mg/l and 0.3 lb/day to a mass limit of 0.45 lb/day. Operating records demonstrate that the WWTP can consistently meet this relaxed limiit without the need to substantially modify the treatment facility. This limit is more stringent than originally requested by the applicant and will not result in a significant increase of phosphorous being dis- charged to the receiving water. A draft permit has been prepared (SPDES # NY-0239577) and is available for review by making an appointment with the contact person.

Project Description:
The applicant is proposing to expand the existing hours of operation of existing facility equipment to a level that will cause the facility to become a major source of air emissions. No new emission sources are planned at this time. As a result of the planned production increase the facility will be a major source of VOC and may be a major source of HAP. Pearl Leather is proposing to cap VOC emissions by limiting the proposed increased emissions to less than 49.5 tons per year above the existing baseline emissions of 47.59 tons per year.This cap will avoid the requirements of 6 NYCRR Part 231-2 New Source Review in Non-attainment areas. Verification of meeting the cap will be made through record keeping to verify coating usage and hours of operation. The expansion of operations may result in the facility being subject to the upcoming MACT standard applicable to Leather Tanning and Finishing Operations, as the facility may become a major source of HAP's. The specifics of the proposed MACT standard will not be known until spring of 2000 when they are published in the Federal Register.The proposed permit and emission cap are available at the Warrensburg office by contacting Sherry Hierholzer of the Division of Air Resources.
