Project Description:
 The Department has made a determination to modify the existing permit of the Village of Cuba Wastewater Treatment Facility in accordance with its Environmental Benefit Permit Strategy. The treatment plant has a permit to discharge a maximum of 970,000 gallons per day, using a monthly average, to New Oil Creek (Water Index Number Pa 53-54-11) which has a classification of C. A special monitoring schedule for the total metals lead, nickel and zinc has been incorporated into the proposed permit because the monitoring results submitted with the permit application reflect the presence of these metals. Additional monitoring is necessary to develop statistically meaningful data before deciding upon the need for final effluent limitations or action levels for these parameters. The draft permit (NY0023515), Fact Sheets, priority ranking fact sheet (score=50) and ranking system are available for review and comment at the regional office.

Project Description:
 The Department has drafted an Air State Facility (ASF) Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and made a tentative determination to approve this application for a modification to the operation of the Samuel A. Carlson Generating Station located at 136 Steele Street. The facility is an electric power plant which operates four low sulfur coal-fired boilers and two steam turbine generator sets, along with auxiliary coal and ash handling equipment. The proposed project involves the construction of two new emission units, a 43 Megawatt (MW) natural gas fired turbine generator system equipped with a heat recovery steam generator, and a 24 MMBtu/hr natural gas fired boiler. The new project is subject to federal 40 CFR 60 New Source Performance Standards and state 6NYCRR Part 227 regulations governing combustion sources. The project will not be subject to the control, emissions offset, or modeling requirements of 6NYCRR 231-2 (New Source Review in Nonattainment Areas and Ozone Transport Regions) or 40 CFR 52.21 Prevention of Significant Deterioration of Air Quality (PSD) review based on capping and netting for various contaminants including: Oxides of Nitrogen (NOx), Carbon Monoxide (CO), and Particulate matter less than or equal to 10 microns (PM-10). A Title V Air Facility Permit application has been submitted and the draft Title V permit will be revised to incorporate the requirements associated with the current project. The facility also holds a Title IV Acid Rain which will be modified to include the gas turbine system. New York Public Service Law Article X requirements for review and permitting of Major Electric Generating Facilities do not apply because this project adds less than 50 MW of new generating capacity. The application and draft permit are available for review at the Region 9 Office.

Project Description:
 The Department has made a tentative determination to approve this application for a new SPDES Permit No. NY-0258733 for a proposed discharge of 1,090 gallons per day of treated sanitary wastewater into an unnamed tributary to Keg Creek, a Class C stream, from a sand filter treatment system (replacement system) at the applicant's existing Maxwell Station, eight unit residential apartments and commercial facility located at 1888 Hess Road. The facility is on the west side of Hess Road and south of Railroad Ave. in Appleton.
