Notice of Complete Application

Clinton County - Notice of Complete Application and a Notice of Non-Applicability of 6NYCRR Subpart 201-6, Title V Facility Permits.

The Department has received a complete application from Wyeth-Ayerst Laboratories to obtain an air pollution control permit for proposed new emission unit no. 0006A at their Rouses Point Facility. This emission unit will involve installation of new equipment to be used for coating of pharmaceutical products. The applicant has requested that the Department put federally enforceable conditions on this certificate which will keep the potential to emit Hazardous Air Pollutants (HAPs) from this project below the thresholds of 25 tons per year for combined HAPs and 10 tons per year for each individual HAP. This makes the project non-major. Therefore, it will receive a State Facility Permit as opposed to a Title V permit. Note that this facility currently has a Title V permit application pending for the rest of the facility. The current facility-wide emissions cap on Volatile Organic Compounds (VOC) will remain unchanged. The applicant has agreed to permit conditions requiring that the exit temperatures of the condensers, which control emissions from the process involved, be kept at or below those shown to provide the necessary control of VOC's used in the process. In addition, the number of batches of product processed will be limited by permit conditions. These limitations result in potential combined HAP emissions of approximately 1.7 tons per year and potential individual HAP emissions of approximately 1.6 and 0.1 tons per year of the two individual HAPs (i.e., methylene chloride and methyl alcohol) emitted. The permittee will be required to monitor and maintain records of condenser exit temperatures and number of batches processed in order to verify compliance with permit conditions and limits. The application is available for review at the Region 5, Ray Brook office as well as in the Warrensburg sub-office. Comments on this project must be submitted in writing to the Contact Person no later than January 21, 2000.

Voluntary Cleanup Agreement

Name of Volunteers: Thomas Roohan and Alfio Bonacio

Project Location: NYSDEC Region 5, Saratoga County, City of Saratoga Springs - High Rock Ave., Saratoga Springs, New York

Project Description: This site is the former Van Raalte Knitting Mill facility which ceased operations in 1986. The site is 4.9 acres in size. The Commissioner executed the voluntary remedial agreement on December 14, 1999. The Volunteers are the new site owners and will address all on-site contamination. Levels of PCB contamination have been detected on interior surfaces of the building and in site soils around an electrical transformer pad. The proposed remedy for this site includes the demolition and removal of the central portion of the building where PCBs were found during a previous investigation, removal and off site disposal of electrical transformers and soils in the transformer area, closure of an inactive petroleum above ground storage tank, characterization and removal of a tar like substance in the area of the tank, and the characterization and disposal of three drums. The site will be utilized for commercial and or industrial purposes after remediation.

Comment Period: The agreement is available for review at the location below. Written comments on this action will be accepted for 30 days following the date of this notice. Written comments expressing objection or opposition to the agreement must explain the basis of that opposition and identify the specific grounds which could lead the department to impose significant changes to the agreement. No formal response is made to comments received, but, as a result of comments the department may re-evaluate and make revisions to the voluntary agreement.

Project Description: The project involves one winter drawdown of Windover Pond of 4.5 feet to begin last week of September-October 2000. Refill would begin on March 1, 2001, with a minimum flow of 15 to 30 cubic feet per minute maintained downstream on Baker Brook. Project objective is to reduce nuisance levels of floating leaf wetland plant which interfere with recreational use of the 99 acre private pond. This will be the third drawdown of the pond. Monitoring of aquatic plant biomass and water quality will continue. The project is located in the Town of Johnsbury, Warren County.

Project Description: Regulated activity involving wetlands. Proposed relocation of snowmobile trail from private lands to State lands due to changes in land use on private lands and to avoid safety concerns from an old sand pit. Portions of the proposed 8 foot wide trail utilize an old road and 41 trees will need to be cut on a new section. Where the proposed trail crosses portions of a wetland, approximately 66 feet of bridging supported by driven 4" by 4" posts will be constructed. The remainder of the snowmobile trail through the forested wetland will consist of a seasonal snow packed trail. Upon completion of the new trail, two old bridges on the abandoned trail will be removed to allow natural restoration of the wetland. The project site is classified State Land Wild Forest - Jessup River Management Unit, located on Rudenston Hill north of County Route 24 (Old Piseco Road) in the Town of Arietta, Hamilton County.

Draft EIS and Public Hearing

Warren County - The Lake George Park Commission, as lead agency has accepted a draft Environmental Impact Statement on the proposed Charles Leonelli Marina Modification. A public hearing on the draft EIS will be held on January 25, 2000 at 10:00 AM at the Holiday Inn, Rt 9, Lake George NY. Written comments on the draft EIS will be accepted until February 5, 2000. The action involves a request to modify a Class A Marina permit to allow rental of up to 16 vessels and the use of two vessels for waterskiing and tubing instruction. The current permit allows the rental of 16 seasonal berthing slips. The project is located at parcel 5-2-11 in the Village of Lake George.
